1. Regulations on planting of construction boundary markers on the field in Vietnam

- The planting of construction boundary markers on the field is implemented for general construction planning projects, sub-zone construction planning, and detailed construction planning.

- Planting construction boundary markers according to approved construction planning includes red line boundaries, construction boundaries, construction levels, and boundaries of construction-restricted areas according to the approved boundary marker dossier.

- After the construction planning project is approved by a competent state agency, the People's Committees at all levels have the following responsibilities:

+ Organizing and approving the boundary marker dossier according to the approved construction planning. The time for preparing and approving the boundary marker dossier shall not exceed 30 days from the date the construction planning project is approved. The setting of boundary markers in the field must be completed within 45 days from the date the boundary marker dossier is approved;

+ Organizing the deployment of boundary marker setting in the field for detailed construction planning projects after an investor has been selected.

- Responsibilities for organizing and implementing the boundary marker setting are stipulated as follows:

+ The People's Committee of the province directs the setting of construction boundary markers for construction planning projects within its administrative boundaries;

+ The People's Committee of the district organizes the setting of construction boundary markers for construction planning projects within its administrative boundaries;

+ The People's Committee of the commune implements the setting of construction boundary markers for construction planning projects within its administrative boundaries.

- The boundary marker dossier is prepared by specialized units.

- Boundary markers must ensure durability, have dimensions according to standards, and display prescribed indicators. They should be easily recognizable, safe for people and vehicles passing by, and suitable for the local topography and geomorphology.

- The People's Committee of the commune is responsible for protecting the boundary markers in the field.

- The agency managing construction planning retains the approved boundary marker dossier and is responsible for providing documents related to the boundary markers to organizations and individuals upon request.

- When construction planning is adjusted, the boundary markers are adjusted according to the revised planning.

- Any person who misplaces construction boundary markers, moves, or damages construction boundary markers will, depending on the nature and extent of the violation, be subject to disciplinary action, administrative penalties, or criminal prosecution. If damage is caused, compensation must be made according to legal regulations.

2. Responsibility to organize the formulation and approval of boundary marker planting tasks and dossiers and on-site planting of boundary markers in Vietnam

Article 9 of Circular 10/2016/TT-BXD stipulates the responsibility to organize the formulation and approval of boundary marker planting tasks and dossiers and on-site planting of boundary markers in Vietnam as follows:

- The People's Committees of provinces and centrally affiliated cities organize, approve tasks, boundary marker dossiers, and deploy boundary marker setting for urban planning projects and specific functional area construction planning under the approval competence of the Prime Minister, the People's Committees of provinces, and centrally affiliated cities in Vietnam.

- The People's Committees of provincial cities and district-level towns organize, approve tasks, boundary marker dossiers, and deploy boundary marker setting for urban planning projects, and specific functional area construction planning within their administrative boundaries, except cases stipulated in Clause 1, Article 9 of Circular 10/2016/TT-BXD.

- The People's Committees of districts organize, approve tasks, boundary marker dossiers, and deploy boundary marker setting for sub-zone planning and detailed planning projects within their administrative boundaries, except cases stipulated in Clause 1, Article 9 of Circular 10/2016/TT-BXD.

- The People's Committees of districts in provinces and centrally affiliated cities organize, approve tasks, boundary marker dossiers, and deploy boundary marker setting for general planning and detailed planning projects for commune-level towns within their administrative boundaries, except cases stipulated in Clause 1, Article 9 of Circular 10/2016/TT-BXD.

- The People's Committees of communes organize tasks, boundary marker dossiers, and deploy boundary marker setting for general construction planning projects managed by them, and submit them to the district-level People's Committees for approval.

- The investor of a construction project under an investment construction project in the form of business organizes, approves tasks, boundary marker dossiers, and cooperates with the People's Committees at all levels to deploy boundary marker setting for detailed planning projects within the project area. Boundary marker dossiers must be approved by the competent authority that appraises the detailed planning projects to ensure compliance with the approved detailed planning and suitability with the technical infrastructure system outside the fence.
