1. Regulations on Integrating information into ID cards in Vietnam under the Law on Identification 2023

According to Article 22 of the Law on Identification 2023, regulations on integrating information into ID cards, and using and extracting integrated information in Vietnam are as follows:

  • Integrating information into an ID card involves adding additional information, aside from identity-specific data, to the card's storage section, and it must be encrypted. The information is integrated upon the citizen's request and must be authenticated through national databases and specialized databases.

  • The information integrated into the ID card includes health insurance card details, social insurance book, driver's license, birth certificate, marriage certificate, or other documents as decided by the Prime Minister, excluding documents issued by the Ministry of Defense.

  • The utilization of the already integrated information into the ID card is equivalent to providing information or using documents containing such information when performing administrative procedures, public services, transactions, and other activities.

  • Citizens may request to integrate information into the ID card when needed or when applying for a new, replacement, or reissued ID card.

  • The extraction of integrated encrypted information within the ID card is governed as follows:

    • Using specialized devices to extract the integrated information in the encrypted storage section of the ID card;

    • Using the information on the ID card through specialized devices to retrieve and extract the integrated information via the National Population Database and the electronic identification and authentication system;

    • Government agencies, political organizations, and socio-political organizations may extract integrated encrypted information within ID cards to perform their assigned functions and duties;

    • Organizations and individuals may extract integrated encrypted information within a citizen's ID card with the citizen's consent.

2. Uses of ID cards in Vietnam

The uses of ID cards according to Article 20 of the Law on Identification 2023 are as follows:

  • The ID card serves as proof of identity and other integrated information on the cardholder for performing administrative procedures, public services, transactions, and other activities within Vietnam's territory.

  • The ID card can replace travel documents in cases where the Socialist Republic of Vietnam and foreign countries sign treaties or international agreements that allow citizens of the signing countries to use ID cards instead of travel documents within each other's territories.

  • The ID card or personal identification number is used by agencies, organizations, and individuals to verify the cardholder's information in the National Population Database, other national databases, and specialized databases as stipulated by law.

When the cardholder is required to present their ID card upon request by authorized agencies, organizations, or individuals, those entities must not request the cardholder to present any documents or provide information already printed or integrated into the ID card. If the information has changed from what is displayed on the ID card, the cardholder must provide legally valid documents or materials that prove the updated information.

  • The state protects the rights and legitimate interests of the cardholders as per legal regulations.
