Regarding this issue, LawNet would like to answer as follows:

On October 9, 2023, the State Audit issued Decision 1252/QD-KTNN regulating the assessment of updating professional knowledge and skills in audit activities of the State Audit.

Regulations on handling violations for civil servants and public employees participating in professional assessment in audit activities in Vietnam

Specifically, for civil servants and public employees participating in the assessment of updating professional knowledge and skills in audit activities of the State Audit violate the assessment rules, minutes must be made, and depending on the severity of the violation, disciplinary action will take the following forms:

(1) Reprimand: applicable to civil servants and public employees participating in the assessment who commit one of the following errors:

- Intentionally sitting in the wrong place to write your registration number;

- Communicate with others who have been warned but still do not comply;

- Bring unused documents into the exam room (unless otherwise specified);

- Using other applications on computers in the exam room other than the software system allowed for use in assessment;

- Bring mobile phones, tape recorders, cameras, and other information and communication means into the exam room (unless otherwise specified), but do not use them.

The form of discipline and reprimand is recorded by the exam invigilator and announced publicly in the exam room. Civil servants and public employees participating in the assessment will have 20% of the assessment results deducted.

(2) Warning: Applicable to civil servants and public employees participating in the assessment who violate one of the following errors:

- Reprimanded but continues to violate evaluation rules;

- Use documents in the exam room (unless otherwise specified in the exam);

- Exchange scratch paper with others in the exam room;

- Using phones, tape recorders, cameras, and other means of information and communication in the exam room (unless otherwise specified in the exam question).

The form of disciplinary warning is recorded by the exam invigilator in the exam room, and exhibits are collected and announced publicly in the exam room. Civil servants and public employees participating in the assessment will have 40% of the assessment results deducted.

(3) Suspension of participation in assessment: applicable to civil servants and public employees participating in assessment who commit one of the following violations:

- Civil servants and public employees participating in the assessment have been given a warning record but still intentionally violate the assessment rules.

- Civil servants and public employees participating in the assessment reveal the exam password to subjects outside the exam room who log in to the civil servant's account on the assessment software.

The form of disciplinary suspension from participating in the assessment is decided by the Head of the Examination Committee and announced publicly in the examination room. Civil servants and public employees participating in the assessment will have an unsatisfactory assessment result and must leave the exam room immediately after the exam invigilator makes a record of suspension of participation in the assessment and there is a decision from the Head of the Examination Committee; They must submit work on the assessment software and cannot leave the exam area.

(4) Civil servants and public employees participating in the assessment of violations according to the levels specified in (1), (2), and (3) are the basis for reviewing and evaluating the quality ranking of civil servants and public employees annually.

In the event that civil servants or public employees participating in the assessment commit serious violations or intentionally cause unsafety in the exam room, they will be disciplined according to regulations.

The purpose of evaluating the updating of professional knowledge and skills in auditing activities in Vietnam

Evaluate the updating of professional knowledge and skills in auditing activities of the State Audit for the purposes of:

- Train and foster a team of civil servants and State Audit officers to meet the requirements of professional tasks.

- Be one of the bases for arranging staff work, audit work, and other tasks related to audit work.

- Encourage civil servants and State Audit employees to increase their sense of self-study and research to improve their professional qualifications and skills.

- Contribute to improving the quality of audit work, staff work, training, and the work of the State Audit.
