Responsibility to disclose voluntary contributions in Vietnam

Pursuant to Clause 1, Article 14 of Decree 93/2021/ND-CP organizations that mobilize, receive, distribute, and use voluntary contributions have the responsibility to fully, promptly and accurately disclose their activities involving the mobilization, receipt, distribution, and use of voluntary donations.

Content of voluntary contributions to be disclosed in Vietnam

Pursuant to Clause 2, Article 14 of Decree 93/2021/ND-CP, the publicity of voluntary contributions must include the following contents:

- Documents on the organization of calling and mobilizing voluntary contributions;

- Results of mobilization (total amount of money and in-kind received), distribution of money and in-kind contributions of organizations and individuals;

- Objects, policies, and levels of support for overcoming difficulties caused by natural disasters, epidemics, and incidents;

- Organizations, agencies, and units directly receiving voluntary contributions shall publicize the time, place, and method of receiving money and the kind of voluntary contributions.

Form of disclosure of voluntary contributions in Vietnam

Pursuant to Clause 3, Article 14 of Decree 93/2021/ND-CP, the publicity of voluntary contributions is made through the following forms:

- Publicize on the official website of the organization, agency, or unit;

- Post at offices of organizations, agencies, units, and places of community activities (villages, hamlets, villages, hamlets, squirrels, residential groups);

- Notify in writing relevant agencies involved in the process of mobilizing, receiving, distributing, and using voluntary donations to overcome difficulties caused by natural disasters, epidemics, and incidents; announcements in the mass media

Carry out at least one of the three forms of publicity specified in Clause 3 of Article 14 of Decree 93/2021/ND-CP; in which the mandatory form is to be published on the official website of the organization, agency, or unit; If there is no website, it must be posted at the head office.

Definitive time to disclose voluntary contributions in Vietnam

Pursuant to Clause 4, Article 14 of Decree 93/2021/ND-CP, the time for disclosing voluntary contributions is prescribed as follows:

- Publicize documents on the organization calling for and mobilizing organizations and individuals to make voluntary contributions in money and in kind right after their issuance;

- Publicize the time, place, and method of receiving voluntary contributions from 01 to 03 days before the start of the implementation;

- Publicize the results of mobilization, receipt, and distribution of voluntary contributions: Publicize the total amount of money and kind that has been mobilized and received no later than 15 days after the end of the receiving period; publicize the total amount of money and kind distributed and used within 30 days from the end of the distribution and use period;

- Publicize support objects, support policies, and support levels right from the beginning of support implementation, including the distribution of money and in-kind contributions for voluntary contributions.

Duration of disclosure of voluntary contributions in Vietnam

Pursuant to Clause 5, Article 14 of Decree 93/2021/ND-CP, the time for disclosing voluntary contributions is as follows:

- Posting publicly at the headquarters of the organization, agency, unit, community activity point, and publicly on the website for 30 days;

- Announcement in the mass media: 03 consecutive issues of newspapers, 03 consecutive days on programs of radio and television stations.
