Regulations on costs of collection, transport and treatment of domestic solid waste in Vietnam (Internet image)
According to Article 79 of the Law on Environmental Protection 2020, the costs of collection, transport and treatment of domestic solid waste in Vietnam are regulated as follows:
- The service price for collecting, transporting, and treating household solid waste from families and individuals is calculated based on the following criteria:
+ Compliance with legal provisions on pricing;
+ Based on the classified mass or volume of waste;
+ Household solid waste that is reusable, recyclable, or hazardous and has been separately classified by families and individuals is exempt from service charges for collection, transportation, and treatment.
- If families and individuals do not classify or improperly classify waste as stipulated in point a and point b of clause 1, Article 75 of the Law on Environmental Protection 2020, they must pay service charges for collection, transportation, and treatment like other household solid waste.
- Agencies, organizations, production facilities, businesses, service units, concentrated production and business areas, industrial clusters generating waste from small-scale office and residential activities as stipulated by the Government of Vietnam may choose to manage household solid waste in the same way as families and individuals as specified in Article 75 of the Law on Environmental Protection 2020 or manage it according to the regulations in clause 4, Article 79 of the same law.
- Agencies, organizations, production facilities, businesses, service units, concentrated production and business areas, industrial clusters producing waste from large-scale office and residential activities as required by the Government of Vietnam must transfer it to facilities with the function of recycling, reusing, or treating waste, or transfer it to collection and transportation facilities with appropriate means to convey waste to facilities with suitable functions.
- The Minister of Natural Resources and Environment provides guidance on the method for pricing the treatment services for household solid waste; specifies economic and technical norms regarding collection, transportation, and treatment; offers technical guidance on waste classification; and guides the implementation of the provisions in clause 1, Article 79 of the Law on Environmental Protection 2020.
- Provincial People's Committees detail the management of household solid waste for families and individuals within their jurisdiction; they determine the specific prices for collection, transportation, and treatment services; and specify the form and the amount families and individuals must pay for these services based on the classified mass or volume of waste.
- The provision in clause 1, Article 79 and clause 1, Article 75 of the Law on Environmental Protection 2020 must be implemented no later than December 31, 2024.
The domestic solid waste treatment is stipulated in Article 78 of the Law on Environmental Protection 2020 as follows:
- The State encourages and provides preferential policies for organizations and individuals investing in and providing waste treatment services; encourages co-processing of household solid waste.
- People's Committees at all levels select facilities for household solid waste treatment by bidding as prescribed by laws on bidding; if it is not possible to select through bidding, resorts to ordering or assigning tasks according to legal provisions.
- Facilities providing household solid waste treatment services must meet environmental protection requirements as specified by the Law on Environmental Protection 2020. Investment in facilities that provide services only within the boundaries of a single commune-level administrative unit is discouraged.
- Household solid waste must be treated using appropriate technology that meets environmental technical standards. The Government of Vietnam prescribes a roadmap for limiting the domestic solid waste treatment using direct burial technology.
- The Minister of Natural Resources and Environment issues criteria regarding technology for household solid waste treatment; guides models for urban and rural waste treatment.
- Provincial People's Committees are responsible for planning, allocating land funds for household solid waste treatment areas, and promptly allocating land for constructing and operating solid waste treatment zones within their jurisdiction; allocating funds for constructing and operating systems for collection, storage, transfer, transportation, and domestic solid waste treatment; and establishing public work systems, measures, and devices for managing household solid waste.
