Regarding this issue, LawNet would like to answer as follows:

1. What is topography?

According to Clause 2, Article 3 of the Law on Topographic and Cartographic 2018, topography means receiving and processing information and data to determine location, shape, size and attribute information of geographical subjects.

2. Regulations on constructing and operating topographic infrastructure works in Vietnam

Regulations on constructing and operating topographic infrastructure works in Vietnam according to Article 13 of Decree 27/2019/ND-CP are as follows:

- Surveying infrastructure works must have operating procedures, including:

+ National satellite positioning station;

+ National remote sensing data collection station;

+ Specialized satellite positioning station;

+ Specialized remote sensing data collection station.

- The operation of surveying infrastructure works is regulated as follows:

+ The investor in the construction of surveying infrastructure works must prepare the operation process and submit it to the competent state agency specified in Clause 4, Article 13 of Decree 27/2019/ND-CP for approval before being put into operation and used;

+ For surveying infrastructure works being exploited and used without operating procedures, organizations assigned to operate topographic infrastructure works are responsible for formulating the operation process and submitting it to competent state agencies specified in Clause 4, Article 13 of Decree 27/2019/ND-CP for approval.

- Maintenance of surveying infrastructure works is a collection of tasks to ensure and maintain the normal and safe operation of the works in accordance with the design regulations during the process of exploitation and use.

Maintenance of surveying infrastructure works includes one, several, or all of the works, including inspection, monitoring, quality control, maintenance, and repair of the works. Each type of surveying infrastructure work must have a maintenance process that stipulates the order, content, and instructions for performing maintenance tasks;

The maintenance process must be suitable and integrated with the operation process of the measuring infrastructure works approved by the competent state agency specified in Clause 4, Article 13 of Decree 27/2019/ND-CP.

- Ministers, heads of ministerial-level agencies, heads of government-attached agencies, and chairmen of provincial-level People's Committees shall organize the operation and maintenance of topographic infrastructure works under their management.

- Organizations and individuals assigned to operate and maintain surveying infrastructure works must comply with the procedures for operation and maintenance to ensure that the topographic infrastructure works always operate normally and according to standards. national technical regulations, technical regulations on design during construction.

- The operation and maintenance of national remote sensing data collection stations and specialized remote sensing data collection stations according to the provisions of the Decree on remote sensing activities.

3. Responsibility to protect the topographic infrastructure works in Vietnam

According to Article 16 of Decree 27/2019/ND-CP, the responsibility to protect the topographic infrastructure works in Vietnam  is as follows:

- Agencies and organizations assigned to directly protect the surveying infrastructure works shall assume the prime responsibility for, and coordinate with the commune-level People's Committees in, publicizing the landmarks and boundaries of the surveying infrastructure protection corridors and taking responsibility for the safety protection of the surveying infrastructure works;

In case the protection corridor of topographic infrastructure works is illegally encroached, occupied, or used, it is necessary to promptly report to and request the commune-level People's Committees of localities where the protection corridors are illegally encroached, occupied, or used for handling; and annually report on the status of metrological infrastructure works as prescribed in Article 4 of Decree 27/2019/ND-CP.

- The People's Committees at all levels where the metrological infrastructure works are located shall have to coordinate with agencies and organizations directly protecting the topographic infrastructure works in propaganda; disseminate the provisions of the law related to the protection of surveying infrastructure works;

Publicly announce landmarks and boundaries of the protection corridor of surveying infrastructure works; promptly handle cases of illegal encroachment, occupation, and use of the protection corridor of topographic infrastructure works.
