Regulations on clothing and equipment for inspection by the People's Public Security Forces in Vietnam (Internet image)

The Minister of Public Security of Vietnam promulgates Circular 09/2021/TT-BCA dated January 20, 2021, regulating the inspection of command, military, and martial arts units of the People's Public Security.

1. Regulations on clothing and equipment for inspection by the People's Public Security Forces in Vietnam

Regulations on uniforms and equipment for inspection by the People's Police under Article 6 of Circular 09/2021/TT-BCA are as follows:

- Skin:

Officers performing the inspection of orders shall wear the uniform of the People's Police and wear the inspection tape of the People's Police orders as prescribed (except in the case of secret inspection).

- Equipment:

+ Means of transport: Depending on the specific situation, police units and localities shall equip cars, motorbikes, and other vehicles to carry out inspection and investigation of People's Police orders.

During the inspection, it is possible to change different types of means of transport to serve the work requirements when performing the inspection task;

+ Technical means and equipment, such as video recorders (cameras), photo cameras, audio recorders, alcohol meters, and other tools.Technical means and equipment must be inspected, calibrated, and certified according to regulations.

+ Test record.

2. Duties of the People's Public Security Command Inspection Officer in Vietnam

According to Article 4 of Circular 09/2021/TT-BCA, the duties of the People's Police command inspection officer are as follows:

- Carrying out the inspection of People's Police orders according to the provisions of Circular 09/2021/TT-BCA.

- Carrying out the Ministry of Public Security's, the Department of Party and Political Work's, and the Heads of Public Security's directions on the inspection and regulation of the People's Public Security.

- Advising and guiding police units, localities and officers and soldiers of People's Public Security to strictly comply with regulations on command, military and martial arts.

- Proposing praise and commendation of units and individuals for well implementation of regulations on command, military and martial arts.

- Reminding, correcting, or requesting that units, officers, and soldiers who violate the People's Public Security Regulations be dealt with in a timely manner.

- Proposing competent authorities take measures to overcome problems and inadequacies in documents regulating the work of the People's Public Security Forces.

3. Powers of the People's Public Security Command inspection officer in Vietnam

The powers of the People's Public Security Inspection Officer, according to Article 5 of Circular 09/2021/TT-BCA, are as follows:

- Reminding, correcting, and making notes of violations of the People's Public Security's orders

+ Leaders and officers of the Command, Military, and Martial Arts Department of the Department of Party and Political Work are reminded, corrected, and made minutes; and they request the handling of units, cadres, and soldiers that violate the regulations of the People's Public Security in the entire police force;

+ Unit and locality leaders and officers inspecting and executing police orders have the following rights:

Remind, correct, make minutes, and propose handling of units, officers, and soldiers violating regulations of the People's Police under their units and localities.

Remind, correct, and make minutes for officers, soldiers, and students of other units, localities, academies, and People's Public Security schools to work, study and live at the units and localities if there is a violation of the People's Public Security order;

For officers, soldiers, and students of agencies, units, academies, and People's Public Security schools stationed in their localities when those cadres, soldiers, and trainees violate the regulations of the People's Public Security outside their agencies or barracks.

After checking and making a record, a written notice must be sent to the unit or locality managing the violating cadres for handling according to regulations; at the same time, send notices to the Bureau of Party and Political Work for general monitoring.

- To temporarily seize documents, means, and objects related to a violation of People's Police regulations in order to facilitate the investigation. The seizure must be made in writing according to Form No. 06 issued together with Circular 09/2021/TT-BCA.

- To use means and techniques such as: cars, motorcycles, video recorders (cameras), cameras, recorders, and alcohol meters when performing tasks.

- To be disguised (not wearing the People's Police uniform) when conducting a secret inspection or a secret inspection combined with publicity.

- To request cadres and soldiers who violate the People's Public Security Command to go to the nearest police station or unit for settlement.

Circular 09/2021/TT-BCA takes effect from March 6, 2021, replacing Circular 28/2013/TT-BCA.
