According to Article 38 of the Law on Identification 2023, the fees for accessing and using information in the National Population Database and fees for issuance, renewal, and reissuance of identity cards, identity certificates are as follows:
- Organizations and individuals specified in Clause 8, Article 10 of the Law on Identification 2023 must pay fees for accessing and using information in the National Population Database in accordance with the law on fees and charges.
- Citizens are exempt from fees when being issued an identity card for the first time.
- Citizens must pay fees when renewing or reissuing an identity card, except for the following cases:
Renewal of identity cards as stipulated in Point a and Point đ, Clause 1, Article 24 of the Law on Identification 2023;
Errors in the information printed on the identity card due to mistakes by the identity management agency.
- No fees are collected for the issuance, renewal, or reissuance of identity certificates for people of Vietnamese origin who have not yet determined their nationality.
The rights and obligations of Vietnamese citizens and Vietnamese residents of undetermined nationality to identification, the national population database and the identification database according to Article 5 of the Law on Identification 2023 are as follows:
* Vietnamese citizens have the following rights:
To have personal data protected in the National Population Database and Identity Database in accordance with the law;
To request the identity management agency to update and adjust their information in the National Population Database, Identity Database, identity card, electronic identity according to the provisions of the law on identity;
To establish the personal identification number of Vietnamese citizens; to be issued, renewed, and reissued identity cards according to the provisions of the Law on Identification 2023; to have identity information and information in the National Population Database confirmed;
To use identity cards, electronic identity in transactions, and to exercise legal rights and benefits;
To access their information in the National Population Database and Identity Database.
* People of Vietnamese origin who have not yet determined their nationality have the following rights:
To have personal data protected in the National Population Database and Identity Database in accordance with the law;
To request the identity management agency to update and adjust their information in the National Population Database, Identity Database, and identity certificate according to the provisions of the law on identity;
To establish the personal identification number of people of Vietnamese origin who have not yet determined their nationality; to be issued, renewed, and reissued identity certificates according to the provisions of the Law on Identification 2023;
To use identity certificates in transactions, and to exercise legal rights and benefits;
To access their information in the National Population Database and Identity Database.
* Vietnamese citizens, people of Vietnamese origin who have not yet determined their nationality have the following obligations:
To complete procedures for issuance, renewal, and reissuance of identity cards, identity certificates according to the provisions of the law on identity; to preserve the issued identity cards, identity certificates;
To provide their full, accurate, and timely information and documents for updating and adjusting information in the National Population Database and Identity Database, identity cards, electronic identity according to the provisions of the law on identity;
To provide their full, accurate, and timely information and documents that have changed from the information on the identity card, identity certificate when conducting related transactions and be responsible for the completeness and accuracy of the information and documents;
To present the identity card, electronic identity, identity certificate, or provide the personal identification number when the competent authority requests according to the provisions of the law;
To submit the identity card, identity certificate to the competent authority in case of renewal, revocation, retention according to the provisions of the Law on Identification 2023.
* Persons who have lost civil behavior capacity, persons with difficulties in perception or behavior control according to the Civil Code 2015, persons under 14 years old may exercise their rights and obligations stipulated in Article 5 of the Law on Identification 2023 through their legal representatives or by themselves with the consent of their legal representatives according to the Civil Code 2015.
