1. Regulations on aviation security control to the aircraft and aircraft operation in Vietnam

Regulations on aviation security control to the aircraft and aircraft operation in Vietnam according to Article 11 Decree 92/2015/ND-CP are as follows:

- Before each flight, the aircraft operator must organize security checks inside and outside the aircraft to detect dangerous items, suspicious people, and objects.

- When passengers disembark from the aircraft at any stopover, the aircraft operator must re-check to ensure that passengers have deplaned and have not left any luggage or items on the aircraft.

- The aviation security control force at airports organizes surveillance and protection of the aircraft by appropriate measures when the aircraft is parked. At specialized airports without an aviation security control force or when the aircraft is parked outside the airport, the aircraft operator is responsible for checking, monitoring, and protecting the aircraft, preventing unauthorized persons or objects from being brought onboard.

- Aircraft repair and maintenance facilities must organize aviation security surveillance and protect the aircraft throughout the repair and maintenance process at the facility.

- The aviation security control force of Vietnamese airlines must organize checks on compliance with aviation security regulations; evaluate the compliance with aviation security standards of airports and related aviation service providers; organize appropriate security checks for passengers, luggage, and cargo for aircraft operations outside the airport area.

- During flight, the aircraft commander is responsible for ensuring security, maintaining order and discipline on the flight; implementing necessary measures to ensure flight safety; cooperating with onboard security personnel on flights to implement appropriate security measures; handing over incidents, violators, and evidence to competent state agencies when the aircraft lands at the airport.

- Upon receiving information concerning security threats related to the aircraft or flight, the aircraft operator must promptly notify the airport emergency force at the relevant airports and implement necessary measures to ensure flight safety.

- Crew members must comply with the commands, directions, and orders of the aircraft commander; implement aviation security measures, and maintain order and discipline on the flight.

- In cases where competent state agencies determine that a flight is likely to experience unlawful interference or at the request of the destination country's authorities, in-flight security personnel must be deployed on that flight.

- In-flight security personnel are part of the Ministry of Public Security's organization and staffing. The cost of deploying in-flight security personnel on the flight is borne by the aircraft operator.

- In-flight security personnel are equipped and authorized to use appropriate weapons and support tools; they are under the overall command of the aircraft commander. In the event of unlawful interference on the flight, in-flight security personnel act according to rules issued by the Minister of Public Security.

2. Regulations on Aviation Security Searches in Vietnam

Regulations on aviation security searches in Vietnam according to Article 9 Decree 92/2015/ND-CP are as follows:

- The aviation security control force at airports performs aviation security searches when necessary as prescribed by law.

- Aviation security searches are conducted on aircraft, passengers, crew members, luggage, cargo, and mail on the aircraft when there is information that dangerous items not been detected or identified during the previous security check and screening process before boarding.

- When someone on the aircraft makes a statement threatening the flight's safety, aviation security searches are conducted on the aircraft and on the person making the statement and their luggage.

- Aviation security searches are carried out when security checks, screenings, and surveillance of passengers, crew members, flight attendants, related individuals, luggage, cargo, mail, or vehicles reveal signs or information threatening the security and safety of the flight.

- In cases where someone at the screening checkpoint or in the restricted area makes a statement threatening the flight's safety, aviation security searches are immediately conducted on the person making the statement and their luggage and items.

- When unidentified luggage or items are found at the airport or in the restricted areas, aviation security searches are immediately conducted on the unidentified luggage or items.

- Aviation security searches are not carried out in cases where individuals are entitled to bodily inviolability under the law.
