Regarding this issue, LawNet would like to answer as follows:

1. Regulations for candidates participating in the exam to promote the rank of Examiner and Court Clerk

Regulations for candidates participating in the examination for promotion to the rank of Examiner and Court Clerk according to Appendix No. 1 issued with Decision 1718/QD-TANDTC in 2017 are as follows:

- The candidates must be present in front of the exam room on time. Dress in accordance with the regulations of the People's Court.

- The candidates must present their ID card or official card for the exam room supervisor to compare when calling into the exam room.

- The candidates must sit in the right seat according to their registration number and put their ID card or official card on the table for the exam room supervisor and exam board members to check.

- Only pens and rulers are allowed into the exam room; Do not bring into the exam room phones, tape recorders, cameras, computers, other means of communication, or other papers and documents related to the exam content (unless the exam has other regulations).

- The candidates must only use the type of test paper given to them to take the test; do not take the test on another paper. They must write all the required items on the test paper. Each exam paper must have the signatures of 02 exam room invigilators. Tests that do not have enough signatures from 02 exam room invigilators are considered invalid.

- The exam can only be written in blue or black ink. Do not use other colored inks, emulsion ink, reflective ink, or pencils to take the exam.

- Except for the mandatory recording on the blank page, candidates are not allowed to write their full name, signature, title, agency name, or other signs on the test.

- The candidates must maintain order and not smoke in the exam room.

- The candidates must not talk to other people during the exam, exchange exam papers or scratch papers, copy other candidates' exams, or commit any other cheating actions to achieve better exam results.

- If the candidates need to ask something, they must ask the exam room supervisor publicly.

- In case it is necessary to rewrite, cross-out, or strikethrough the written part of the exam (unless the exam has other regulations).

- The candidates are only allowed to leave the exam room after 2/3 of the test time and must be approved by the exam room supervisor. The candidates are not allowed to leave the exam room for subjects with a duration of less than 60 minutes.

- In the event that a candidate has unusual pain or illness, they must report it to the exam room proctor, and the test room proctor must immediately notify the Head of the exam committee for consideration and resolution.

- The candidates must stop writing and submit it to the exam room proctor immediately after the test room proctor declares the end of the exam time. They must clearly state the number of sheets and pages of the submitted exam and sign the exam submission list. In case they fail to complete the exam, candidates must also submit the exam paper again.

2. Regulations on handling violations for candidates participating in the exam to promote the rank of Examiner and Court Clerk in Vietnam

Regulations on handling violations for candidates participating in the examination to promote the rank of Examiner and Court Clerk according to Appendix No. 1 issued with Decision 1718/QD-TANDTC in 2017 are as follows:

* Candidates who violate exam rules must keep a record, and depending on the severity of the violation, they will be disciplined in the following ways:

** Reprimand

This measure applies to candidates who commit one of the following:

- Intentionally sitting in the wrong place to write your registration number;

- Communicate with others who have been warned but still do not comply;

- Bring documents into the exam room but have not used them (except in cases where the exam has regulations stating that you can bring documents into the exam room).

The form of disciplinary reprimand is recorded by the exam room supervisor and announced publicly in the exam room. Candidates who are reprimanded for any test will have 20% of their test score deducted for that test.

** Warning

This measure applies to candidates who commit one of the following:

- Have been reprimanded but continue to violate exam room rules;

- Use documents in the exam room (except in cases where the exam questions stipulate that you can use documents in the exam room);

- Exchange scratch papers and exam papers with each other;

- Copy other people's work;

- Use phones, tape recorders, cameras, computers, and other means of communication in the exam room (unless otherwise specified in the exam question).

The form of disciplinary warning is recorded by the exam room supervisor, confiscating evidence, and announced publicly in the exam room. Candidates who receive a warning on any test will have 40% of their test score deducted for that test.

** Suspension of exam

This measure applies to violators who have been given a warning record but still intentionally violate exam rules;

The form of disciplinary suspension is decided by the Head of the Examination Committee and announced publicly in the examination room. If a candidate is suspended from taking any subject, that subject's exam will be graded 0.

** Cancellation of exam results: applicable to candidates who are discovered to have swapped exams, taken the exam for them, or have been disciplined in the previous exam but still intentionally violate the rules in the following exam to the point of warning. .

** If candidates commit serious violations and intentionally cause unsafety in the exam room, they will be handled according to the provisions of law.

* In cases where candidates violate exam rules, a record must be made, and then 02 exam room supervisors and the candidate must sign the record. After making a record and announcing it publicly in the exam room, the examiner of an exam room must immediately report to the Head of the exam committee.

* Candidates have the right to report violators of exam rules and regulations to the proctor, the Head of the Exam Committee or the Exam Council.
