Regarding this issue, LawNet would like to answer as follows:
According to Article 5 of Decree 70/2019/ND-CP, citizens are selected to join the People's Police when they meet the following criteria:
- Have a clear background.
- Strictly abide by the lines and guidelines of the Party, policies, and laws of the State; having no criminal record; not being examined for penal liability or probation; not during the period of being applied the measure of education in communes, wards, or townships or sent to compulsory medical treatment establishments or compulsory educational institutions; having good qualities, ethics, and conduct; being trusted by the masses of the people in the place of residence or place of study or work.
- Ensure the political standards of non-commissioned officers and soldiers serving according to the duty regime in the People's Public Security.
- Have a high school diploma or higher. Communes in mountainous areas, islands, ethnic minority areas, and areas with extremely difficult socio-economic conditions may recruit citizens with lower secondary school diplomas.
- Have a well-balanced physique, not deformed or deformed, and meet the health standards to perform the obligation to join the People's Police.
Specifically, Article 8 of Decree 70/2019/ND-CP stipulates the regimes and policies for citizens performing the people's police duty as follows:
(1) During the period of medical examination under the order of the Chief of District Police, citizens participating in the selection to perform their duty to join the People's Police are entitled to the prescribed regimes and policies for citizens during the period of medical examination and examination for military service.
(2) During active service and upon discharge as non-commissioned officers, conscripts are entitled to the regimes and policies prescribed for non-commissioned officers and soldiers serving in the people's armed forces prescribed in Article 50 of the Law on Military Service 2015 and documents detailing the implementation:
- For non-commissioned officers and soldiers during active service:
+ Being assured of a timely, sufficient, and correct supply of food, foodstuffs, military equipment, and preventive and curative drugs; be guaranteed accommodation, a monthly allowance, necessities, and cultural and spiritual needs suitable to the nature of the army's tasks; regimes are guaranteed during holidays and Tet; be guaranteed health care when injured, sick, or having accidents according to the provisions of law;
+ From the thirteenth month onwards, they are entitled to leave according to the regime; other irregular leave cases prescribed by the Minister of National Defense;
+ From the twenty-fifth month onward, an additional 250% of the monthly current army rank allowance shall be enjoyed;
+ Being counted in family size when the family is assigned or adjusted to the area of housing, land for housing construction, and arable land;
+ Time to serve in the army will be counted into the working time;
+ Geting preferential postage;
+ Having achievements in combat, work, and training shall be commended and rewarded according to the provisions of law;
+ In case of injury or illness while on duty, they are entitled to preferential regimes as prescribed by law;
+ The State guarantees the social insurance and health insurance regimes according to the provisions of the Law on Social Insurance and the Law on Health Insurance;
+ Being entitled to suspend payment and not charge interest on loans from the Bank for Social Policies that, before enlistment, are members of poor households, pupils, or students as prescribed by law;
+ Priority in military enrollment.
- For relatives of non-commissioned officers and active-duty soldiers:
+ Biological father and mother; father, mother-in-law; legal guardian; wife or husband; The natural and lawfully adopted children of non-commissioned officers and active-duty soldiers are entitled to the health insurance regime in accordance with the Law on Health Insurance and the hardship allowance guaranteed by the state budget;
+ Biological children and legally adopted children of non-commissioned officers and soldiers in active duty are exempted or reduced in tuition when studying at public and non-public general education establishments according to the provisions of law on tuition exemption and reduction;
+ In the event that non-commissioned officers and active-duty soldiers die while on duty, their families are entitled to preferential treatment as prescribed by law.
- For non-commissioned officers and soldiers upon discharge:
+ Be granted transportation allowance, travel allowance, and demobilization allowance;
+ Before joining the army, if they are studying or have a call to study at schools belonging to vocational education establishments or higher education establishments, their results will be reserved and you will be accepted to study at those schools;
+ Receive job creation subsidies;
+ Before enlistment, while working at a state agency, political organization, or socio-political organization, when discharged from the army, such agency or organization must be responsible for receiving and arranging jobs and ensuring that the income is not lower than before enlistment; in the event that that agency or organization has been dissolved, the immediate superior agency or organization is responsible for arranging suitable jobs;
+ Before joining the army, if you are working at an economic organization when demobilized, that organization must be responsible for receiving, arranging jobs, and ensuring salaries and wages commensurate with the job position and salary before enlistment; In case the economic organization has ceased operations, dissolved, or gone bankrupt, the settlement of regimes and policies for demobilized non-commissioned officers and soldiers shall be implemented as for employees of that economic organization according to the provisions of law;
+ Receive social insurance benefits according to the provisions of the Law on Social Insurance;
+ For non-commissioned officers and soldiers demobilized according to the provisions of Clause 1, Article 43 and Clause 1, Article 48 of the Law on Military Service 2015, when returning to the locality, the government at all levels, agencies, and organizations prioritizes job placement and adds points in enrollment and recruitment of civil servants and public employees; During the probationary period, you will receive 100% of the salary and allowances of the recruitment rank corresponding to the training level.
