Regulation on reporting on the implementation of investment activities in PPP mode (Public-Private Partnership) in Vietnam

This is one of the highlights at Decree 35/2021/NĐ-CP detailing and guiding the implementation of the Investment Law in the form of public-private partnership, effective from March 29, 2021 in Vietnam

What is the PPP model?

PPP (Public - Private Partnership): Investment in the form of public-private partnership (hereinafter referred to as PPP) is an investment made on the basis of a contract between a competent state agency and an investor or project enterprise for the implementation, management and operation of infrastructure projects and provision of public services in Vietnam.

Key contents to report on the implementation of PPP investment activities in Vietnam

For the report on the implementation of investment activities in Vietnam by PPP method, the main contents to be reported include:

- PPP project implementation: basic information about PPP projects; project preparation progress, investor selection; PPP project contract implementation;

- The issuance of documents guiding and directing the implementation of investment activities in Vietnam by PPP method;

- The arrangement of personnel to carry out investment activities in PPP mode;

- Results achieved, survival, difficulties, challenges, causes and recommendations for solutions.

Modalities for the implementation of the report on the implementation of investment activities under PPP modality

Reporting on the implementation of investment activities in Vietnam by PPP method is carried out simultaneously in both forms as follows:

- Dispatch by post;

- Send on the National e-procurement system according to the roadmap specified at Point b, Clause 1, Article 93 of Decree 35/2021/ND-CP.

Deadline for implementation of the report on the implementation of investment activities in Vietnam under PPP method

Reports on the implementation of investment activities in Vietnam under the PPP method on an annual basis by ministries, central agencies, other agencies and provincial People's Committees shall be sent to the Ministry of Planning and Investment before March 31 of the following year of the reporting period.

The Ministry of Planning and Investment is responsible for receiving, managing, evaluating and summarizing information on investment activities in PPP mode and reporting to the Prime Minister on an annual basis.

Based on the investment monitoring and evaluation report in accordance with the Government's regulations on investment monitoring and evaluation conducted by PPP project enterprises in Vietnam, the general contracting agency shall report to ministries, central agencies, other agencies and provincial People's Committees on the implementation of PPP project contracts.
