In Article 45 of Decree 175/2024/ND-CP, guidelines have been provided regarding the documentation for submission and appraisal of construction design post-basic design at specialized construction agencies, as follows:

(1) The documentation for appraisal submission must ensure legal validity and be appropriate to the content requested for appraisal. The documentation is considered valid when it complies with the content stipulated in (2), is in the correct format, presented mainly in Vietnamese, has been checked and verified by the submitter, and carries responsibility under the law for its accuracy.

(2) The documentation for appraisal of construction design post-basic design includes:

- A presentation for appraisal as stipulated in Template No. 08 Appendix I of Decree 175/2024/ND-CP;

- Legal documents attached, including: the construction investment project approval decision accompanied by the approved feasibility study report; notification of appraisal results from specialized construction agencies and design documents with confirmation stamp; appraisal report of construction design by the consultancy appraiser contractor confirmed by the investor (if required); design approval document on fire prevention and fighting (if required by the law on fire prevention and fighting) and other related documents.

The fire prevention and fighting procedures are conducted simultaneously, and presenting it at the time of submission for appraisal is not mandatory, but results must be submitted to the specialized construction agency 5 days before the appraisal results are notified;

- Construction survey documentation approved by the investor; construction design documentation for the construction design phase submitted for appraisal;

- Certificate number for construction activity capacity of the survey contractor, construction design contractor, appraisal contractor; certificate number for the professional construction activity of the chief surveyor, chief, head of design disciplines; chief, head of appraisers; construction activity permit for foreign contractors (if any);

- For public investment-funded projects or state capital outside public investment, besides the contents stipulated in points a, b, c, and d of this section, appraisal submission documentation must include construction estimates; related information, data on prices, norms, quotations, appraisal results (if any) to determine the construction estimate;

- For projects with administrative violations in construction that have been penalized and require remediation measures including appraisal, adjustment appraisal, issuance or adjustment of construction permits, the appraisal submission documentation must also include content such as: Investor's report on project execution, current situation of project construction works up to the time of appraisal submission; minutes, administrative penalty decision of the competent authority; Building inspection report assessing the load-bearing capacity of the already constructed part of the building;

- For repair and renovation projects, the appraisal submission documentation must also include: Current status survey documentation, Building inspection report assessing the load-bearing capacity of the building.

Regulations on managing construction design activities in Vietnam

- The construction design contractor is responsible for the quality of construction design they perform; appraisal, evaluation, and approval of construction design by individuals, organizations, investors, the investment decision-maker, or specialized construction agencies do not replace or diminish the responsibility of the construction design contractor for the quality of the construction design they perform.

- During the construction design process for major national projects, large-scale or technically complex projects, the construction design contractor may propose the investor to conduct experiments and simulations to check, calculate the working capability of the structure to perfect the construction design, ensuring technical and safety requirements.

- After the construction design documentation is appraised and approved as prescribed, the investor checks the completed workload compared to the construction contract provisions and issues a written approval for the acceptance of construction design documentation to the construction design contractor if it meets the requirements.
