Regulation on 04 cases requiring testing for narcotic substance in body in Vietnam

According to Article 22 of the Law on Prevention and Control of Narcotic Substances 2021, testing for narcotic substance in body is regulated as follows:

- Testing for narcotic substance in body is conducted for individuals in the following cases:

(1) Individuals found using illegal narcotic substances;

(2) Individuals whom authorities or authorized individuals have evidence to suspect of illegal narcotic substance use;

(3) Individuals using illegal narcotic substances who are currently under management;

(4) Individuals currently subject to administrative measures for education at the commune-level due to illegal narcotic substance use; are undergoing narcotic substance detoxification; are being treated for opioid addiction with substitute medication; are under post-detoxification management.

- Heads of narcotic substance rehabilitation centers, centers for treating opioid addiction with substitute medication; individuals with the authority to impose administrative penalties for illegal narcotic substance use, conduct narcotic substance tests as per their authority or request agencies and professionals to test narcotic substances in the body for cases specified in Clause 1, Article 22 of the Law on Prevention and Control of Narcotic Substances 2021.

In cases of positive test results, the results must be promptly sent to the Chairman of the commune-level People's Committee where the individual with the positive result resides, except for those undergoing mandatory narcotic substance detoxification.

- The State ensures funding for testing for narcotic substance in body for cases specified in Clause 1, Article 22 of the Law on Prevention and Control of Narcotic Substances 2021.

Prohibited Acts in Prevention and Control of Narcotic Substances in Vietnam

Prohibited acts in Prevention and Control of Narcotic Substances in Vietnam are stipulated in Article 5 of the Law on Prevention and Control of Narcotic Substances 2021 and include:

- Cultivating plants containing narcotic substances, instructing the cultivation of plants containing narcotic substances.

- Researching, examining, testing, producing, storing, transporting, preserving, possessing, trading, distributing, processing, exchanging, exporting, importing, temporarily importing, re-exporting, temporarily exporting, re-importing, transiting illegal narcotic substances, precursors, narcotic narcotic substances, psychotropic narcotic substances, precursor narcotic substances, materials for producing narcotic narcotic substances, psychotropic narcotic substances, precursors for producing narcotic substances, veterinary narcotic substances containing narcotic substances, precursors.

- Illegally possessing narcotic substances, precursors, narcotic narcotic substances, psychotropic narcotic substances, precursor narcotic substances, materials for producing narcotic narcotic substances, psychotropic narcotic substances, precursors for producing narcotic substances, veterinary narcotic substances containing narcotic substances, precursors.

- Illegally handing over, managing, supervising, storing, issuing, and preserving narcotic substances, precursors; permitting individuals to use narcotic narcotic substances, narcotic or psychotropic narcotic substances illegally.

- Using, organizing the illegal use of narcotic substances; coercing or enticing others to use narcotic substances illegally; harboring or facilitating the illegal use of narcotic substances.

- Producing, storing, transporting, trading means and tools for the production or illegal use of narcotic substances.

- Resisting or obstructing narcotic substance tests, determining narcotic substance addiction status, managing illegal narcotic substance users, narcotic substance detoxification, post-detoxification management.

- Retaliating or obstructing individuals performing narcotic substance prevention and control duties, participants in narcotic substance prevention and control.

- Abusing position, authority, or profession to violate narcotic substance prevention and control laws.

- Instructing the production, illegal use of narcotic substances; advertising, marketing narcotic substances.

- Discriminating against illegal narcotic substance users, individuals undergoing narcotic substance detoxification, post-detoxification individuals.

- Other acts prohibited by law related to narcotic substances.
