Regarding this issue, LawNet would like to answer as follows:

1. Purchase price of automobile in units of the people's armed forces in Vietnam

The purchase price of automobile in units of the people's armed forces according to Article 7 of Decree 85/2018/ND-CP is as follows:

(1) automobile purchase price:

- The purchase price of a title automobile shall comply with the provisions of Clauses 1, 2 and 3, Article 3 of Decree 85/2018/ND-CP:

+ Standards and norms for using automobiles of leading cadres in the People's Army and People's Public Security who are Politburo members, the Secretary of the Party Central Committee, or a member of the Party Central Committee. Ministers, Deputy Ministers, General Directors, and their equivalents shall comply with the Government's Decree on standards and norms for the use of automobiles.

+ The following are the standards and norms for using automobiles based on military rank:

++ The officer with the highest military rank is a General who is entitled to regularly use 01 automobile during his working time. Based on the actual situation at the time of equipping the vehicle, the Prime Minister shall decide on the type and purchase price of the vehicle at the request of the Minister of National Defense or the Minister of Public Security;

++ The officer with the highest military rank is a Lieutenant General, Navy Admiral, who is entitled to regularly use 01 automobile during his working time with a maximum purchase price of VND 1,100 million/vehicle;

++ The officer with the highest military rank is a Lieutenant General, a Vice Admiral of the Navy, who can regularly use 01 automobile during their working time with a maximum purchase price of 920 million VND/automobile;

++ Officers with the military rank of Major General, Rear Admiral of the Navy, are allowed to use automobiles to transport from their places of residence to work or on business trips, with a maximum purchase price of 820 million VND/automobile.

+ Standards and norms for using title automobiles at state-owned enterprises under the Ministry of National Defense and the Ministry of Public Security shall comply with the Government's Decree on standards and norms for the use of automobiles.

- The maximum purchase price of automobile for general work specified in Article 4, Clause 1, Article 6 of Decree 85/2018/ND-CP is 720 million VND/vehicle;

- The purchase price of a special-use automobile shall be decided by the Minister of National Defense or the Minister of Public Security in accordance with the requirements of performing tasks, the state budget capacity, and ensuring thrift and efficiency.

(2) The purchase price of automobiles for job titles, automobiles for general work at agencies and units that regularly operate in mountainous, remote, and isolated areas; areas with extremely difficult socio-economic conditions as prescribed by the Government or the Prime Minister not exceeding:

1.5 times the price specified at Points a and b, Clause 1, Article 7 of Decree 85/2018/ND-CP when buying a 2-wheeler automobile. In case it is necessary to buy automobile with 12 to 16 seats, the maximum purchase price is 1,100 million VND/automobile.

(3) The purchase price of automobile specified in Clauses 1 and 2 of this Article is the purchase price inclusive of taxes payable as prescribed by law, excluding the registration fee, license plate fee, insurance fee, registration fee, and road maintenance fee related to the use of the vehicle.

In case automobiles are exempt from taxes, the exempted tax amount must be calculated enough to determine standards and norms. The price of automobiles used as a basis for determining standards and norms in the case of handing over and transferring used automobiles must comply with the Government's Decree on standards and norms for automobile use.

(4) The adjustment of the automobile purchase price at units of the People's Armed Forces shall comply with the provisions of the Government's Decree on standards and norms for the use of automobiles.

2. Rearrange and handle automobiles in units of the people's armed forces in Vietnam

Rearrange and handle automobiles in units of the people's armed forces in Vietnam according to Article 9 of Decree 85/2018/ND-CP as follows:

- Pursuant to the standards and norms for using automobiles specified in Decree 85/2018/ND-CP, the Minister of National Defense and the Minister of Public Security shall direct functional agencies under their management to review and rearrange the number of existing automobiles;

Handling redundant automobiles (if any) according to the forms specified in the Law on Management and Use of Public Property, Decree 151/2017/ND-CP, and relevant laws.

- In case, after the review, the units still lack automobiles compared to the prescribed standards and norms, they will be handled as follows:

+ Agencies or persons competent to decide to transfer automobiles from units with redundant automobiles after reviewing;

+ Agencies or persons competent to decide to hand over assets being automobiles to units for management and use according to the provisions of the Law on Management and Use of Public Property;

+ Agencies or persons competent to decide on the purchase of automobiles within the scope of the assigned state budget estimates and other lawful funding sources as prescribed by law.
