Regarding this issue, LawNet would like to answer as follows:

Draft Decree detailing and guiding the implementation of the Law on Medical Examination and Treatment (2nd edition)

1. Proposed practice content for the issuance of a medical examination and treatment practice license in Vietnam

According to Article 4 of the draft Decree detailing and guiding the implementation of the Law on Medical Examination and Treatment (2nd edition), the proposed practice content for granting medical examination and treatment practice licenses includes:

- Medical examination and treatment practice skills consistent with the practitioner's professional qualifications.

- Emergency resuscitation techniques, patient safety, and medical incident handling.

- Legal knowledge about medical examination and treatment.

- Professional regulations, professional ethics, communication skills, and behavior towards patients.

2. Proposed medical practice time for professional positions in Vietnam

- Time spent practicing medical examination and treatment for each position:

+ Doctor: 12 months;

+ Physician: 9 months;

+ Nursing, midwifery, medical technology, clinical nutrition, clinical psychology, outpatient paramedic: 6 months.

- Practice facilities are responsible for ensuring that practitioners can work as practitioners at their facility.

During practice due to health reasons or force majeure, the practitioner is allowed to temporarily suspend practice for a maximum period of 12 months and retain previous practice results.

- Reservation of practice results is carried out as follows:

+ The practitioner submits a written request to reserve the practice results and attaches documents proving the reason for the request to reserve;

+ Based on the request of the practitioner, the head of the medical examination and treatment facility shall consider and decide to allow reservations; In cases of disagreement, there must be a written response clearly stating the reason;

+ Within 30 days after the expiration of the reservation period, if the practitioner does not make a written request to continue practicing or to extend the reservation period, the reservation result is no longer valid (total duration of reservations must not exceed 12 months).

- In case the practitioner moves to another practice facility, the practice results at the previous facility cannot be preserved. Except in cases where these practice facilities have signed a practical training cooperation contract.

3. Proposal for medical examination and treatment practice facilities in Vietnam

Proposed practice facilities for each professional title are as follows:

- Practice facility for the title of doctor: medical examination and treatment facility licensed to operate in the form of organization as a hospital with corresponding department.

- Practice basis for the title of doctor: medical examination and treatment establishments licensed to operate under the organizational form are hospitals with departments corresponding to medical degrees of doctors and armed forces infirmaries with inpatient beds.

- Practice facilities for nursing positions: medical examination and treatment facilities licensed to operate in the form of a hospital or infirmary belonging to the armed forces with inpatient beds.

- Practice facility for the title of Midwife: a medical examination and treatment facility licensed to operate in the form of an organization as a maternity home or a hospital with obstetrics and pediatrics departments.

- Practice basis for medical technical titles: Medical examination and treatment facilities licensed to operate in the form of organization are hospitals, clinics belonging to the armed forces, and clinics with a scope of operation consistent with the practice content of medical techniques.

- Practice facilities for the title of out-of-hospital emergency care: medical examination and treatment facilities licensed to operate in the form of a hospital or out-of-hospital emergency facility.

- Practice facilities for clinical nutrition titles: medical examination and treatment facilities licensed to operate in the form of a hospital and have a nutrition department.

- Practice basis for clinical psychology titles: a medical examination and treatment establishment licensed to operate in the form of a psychotherapeutic establishment; a psychiatric hospital; a general or specialized hospital with a psychiatry or psychotherapy department.
