Proposed fine of up to 500,000 VND for failing to change ID card/CID card in accordance with regulations in Vietnam

Currently, point b clause 1 Article 9 Decree 167/2013/ND-CP stipulates that the behavior of not following the provisions of the law on the issuance, re-issuance, changing ID card will be fined from 100,000 VND to 200,000 VND in Vietnam. However, this fine is proposed to be changed under the Draft Decree to replace Decree 167.

Specifically, at Point b, Clause 1, Article 10 of the Draft Decree providing for penalties for administrative violations in the field of social security, order and safety; prevention of social evils; fire protection; rescue and rescue; domestic violence prevention and control (replacing Decree 167/2013/ND-CP) proposes fines for acts of failure to comply with regulations of law on issuance, replacement, reissuance of the citizen identity card in Vietnam as follows:

A warning or a fine ranging from 300.000 VND to 500.000 VND shall be imposed for failure to comply with regulations of law on issuance, replacement, reissuance of the citizen identity card.

Currently, Point b, Clause 1, Article 9 of Decree 167 only states "A warning or a fine of between VND 100,000 and 200,000 shall be imposed for failure to comply with regulations of law on issuance, replacement, reissuance of the citizen identity card."

The new Draft Decree has added the application of fines for violations in terms of granting and exchanging citizen IDs (currently only applied to ID cards).

Thus, those who do not change their ID card/CCCD in cases where it is mandatory to change according to regulations will be subject to a warning or a fine of from 300,000 VND to 500,000 VND.

Cases that have to carry out procedures for renewal and re-issuance of ID cards/CID card in Vietnam

* For people who have been granted ID cards in Vietnam according to Article 5 of Decree 05/1999/ND-CP:

- The following cases must go through procedures for change of the people’s identity cards:

+ The people’s identity card has expired;

+ The people’s identity card is damaged and unusable;

+ There is a change in the family name, given name, middle name, day, month and/or year of birth;

+ The permanent residence registration place has changed to outside the province or centrally-run city;

+ There is a change to the identification particulars.

- If a people’s identity card is lost, the re-granting procedures must be carried out.

* For those who have been issued a barcode CID card or a CID card with a chip in Vietnam, according to Article 23 of the Law on Citizenship Identification 2014, specifically:

- A citizen’s identity card shall be renewed in the following cases:

+ The cases specified in Clause 1, Article 21 of this Law;

+ The card is damaged and unusable;

+ Change of family name, middle name, first name and characteristics for identification of the card holder;

+ Gender re-assignment or native place re-determination;

+ There is incorrect information in the citizen’s identity card;

+ Upon request of the card holder.

- A citizen’s identity card shall be re-granted in the following cases:

+ It is lost;

+ The card holder has Vietnamese nationality restored under the Law on Vietnamese Nationality.
