1. Prohibited acts of agencies, organizations, officials, and individuals in encouraging and protecting officials in Vietnam

The prohibited acts of agencies, organizations, officials, and individuals in encouraging and protecting officials in Vietnam according to Article 6 Decree 73/2023/ND-CP are as follows:

- Exploiting policies and measures to encourage and protect officials to carry out or cover up acts of corruption, negativity, profiteering, violating the discipline of the Communist Party and the laws of the State, or affecting the implementation of political duties, negatively impacting the people's lives, and the business and production activities of enterprises.

- Obstructing, causing difficulties, insulting the honor and dignity of dynamic and creative officials, agencies, organizations, and individuals involved in proposing, implementing, and completing proposals for the common interest.

- Avoiding or pushing responsibilities in the process of approving and implementing proposals for innovation and creativity.

- Not complying with the assignment of tasks by the agency or organization for carrying out proposals; not performing the proposals as decided by the employing agency; not following the directives of the employing agency regarding the continuation, suspension, or termination of proposals; exploiting the implementation of proposals to avoid, push, or neglect responsibilities in carrying out other assigned duties according to legal regulations, internal rules, and regulations of the agency.

- Handling responsibilities for dynamic and creative officials, agencies, organizations, and individuals involved in the process of proposing and implementing proposals that have been evaluated as completed according to Article 18 Decree 73/2023/ND-CP.

2. Principles of Encouraging and Protecting Officials in Vietnam

The principles of encouraging and protecting officials in Vietnam according to Article 4 Decree 73/2023/ND-CP are as follows:

- Dynamic, creative officials who dare to think, dare to do, and dare to take responsibility for the common good must be encouraged and protected.

- Encouraging and protecting officials who propose innovations and creativity, which are reviewed and decided for implementation by the employing agency within its decision-making authority as stipulated by law, ensuring compliance with the regulations of the Communist Party, the legal normative documents of the National Assembly, the Standing Committee of the National Assembly, superior state agencies, and international treaties to which the Socialist Republic of Vietnam is a member.

- Officials who propose innovations and creativity reviewed and decided for implementation by the employing agency, whose results contribute to the construction and development of the country, sectors, fields, locales, agencies, units, are recognized, honored, and appropriately rewarded. The employing agency reports and seeks the guidance of the corresponding Party committee and organization before approving and evaluating the implementation results of innovations and creativity.

- Encouragement and protection of officials must be conducted promptly, democratically, openly, transparently; correctly following the subjects, processes, and procedures as stipulated in Decree 73/2023/ND-CP and related laws. Agencies and authorized individuals must promptly review, evaluate the implementation results, clearly identify objective and subjective causes, and conduct an objective and comprehensive evaluation of the proposals and the implementation of innovations and creativity.

- Dynamic, creative officials for the common good may not be held accountable, may be exempted from, or may have their responsibilities reduced according to the provisions of clauses 1, 2, and 3 of Article 11 Decree 73/2023/ND-CP.
