Regarding this issue, LawNet would like to answer as follows:
1. Traditional lottery ticket withdrawal process in Vietnam
The process of withdrawing traditional lottery tickets according to Appendix 1 issued together with Circular 75/2013/TT-BTC is as follows:
(1) The withdrawal of a traditional lottery ticket must be fully implemented in the following order:
- Step 1: Before submitting unsold tickets, lottery agents must take measures to disable all lottery tickets that are not sold out according to the regulations of the lottery company. At the same time, the lottery agent must make a list of the sold tickets and return them to the lottery company.
The form of invalidation shall be prescribed by the lottery company in the regulations regulating the process of withdrawing lottery tickets and guiding the lottery agents to implement it. The use of measures to disable lottery tickets, such as: cutting corners, punching holes, etc., must ensure the principle of not letting disabled tickets be used to receive prizes.
- Step 2: Lottery agents submit invalidated tickets that have not been sold out together with a statement to the ticket collection officer of the lottery company. Ticket collectors must check to ensure that 100% of tickets that are not sold out and revoked have been disabled in accordance with regulations.
In case, detecting that there are tickets that have not been invalidated according to regulations, the lottery company shall report to the Lottery Supervision Board to monitor the invalidation again.
- Step 3: The lottery company counts and compares with the lottery agent's list of unsold tickets and confirms the number of tickets withdrawn.
- Step 4: After revoking tickets, for the lottery company that seals all tickets that are not sold out and are withdrawn, the sealing paper must be signed by the representative of the Supervisory Council, and the representative of the lottery company clearly specifies the date and time to seal and enter the archive.
(2) The entire implementation process from step 2, step 3, and step 4 must be supervised by the Lottery Supervision Council. For ticket collection points located outside the head office and not organized by the Lottery Supervision Council, Lottery companies still have to fully perform the above steps and repeat steps 3 and 4 at the head office or arranged locations to re-count tickets and seal them before entering the archive.
(3) According to management requirements, the lottery company shall set a time limit for lottery agents to return unsold tickets to ticket collection points according to regulations. In order to ensure that the withdrawal of sold lottery tickets is not completed, it must be completed at least 15 minutes before the start of the lottery.
In the event that the lottery agent submits the ticket later than the prescribed time, the lottery company is entitled to refuse to accept the tickets that are not sold out. Lottery agents are responsible for paying the value of prizes if they have sold tickets to customers but have not completed the procedures to submit incomplete tickets to the lottery company.
Lottery agents are responsible for submitting unsold tickets to the lottery company within the time limit specified by the lottery company.
(4) For traditional lottery tickets that have not yet been put into circulation in the issued batch (if any), the withdrawal and counting shall also be carried out according to the principles at (1), (2), and (3) above.
(5) Based on the work steps specified in (1), (2), and (3) above, the lottery company builds and promulgates regulations detailing the process of withdrawing lottery tickets. Traditional designs are not sold out.
The procedure for withdrawing ticket stubs or manual stored parts according to Appendix II issued together with Circular 75/2013/TT-BTC is as follows:
(1) The withdrawal of the ticket stub or the stored parts of a manual lottery ticket must be fully completed in the following sequence:
- Step 1: Lottery agents make a list according to each type of product, ticket face value, prize money, and prize number attached to the ticket stub or the stored parts of the manual lottery ticket submitted to the lottery company according to regulations.
For lottery agents and ticket collection points far from the headquarters of the lottery company that cannot be organized by the Lottery Supervision Council, the lottery company requires the lottery agent or the officer assigned to withdraw the tickets to send the above list to the lottery company before the prescribed time of drawing.
- Step 2: The ticket-collecting officer of the lottery company shall tally and compare the list with the ticket stub or the manual lottery ticket that is submitted by the lottery agent.
After counting and comparing, the ticket-collecting officer of the lottery company must sign for certification on the lottery agent's list and report to the Lottery Supervisory Council to sign the list or a summary of the winning numbers established by the lottery company. The entire process specified in steps 1 and 2 above must be done before the drawing time.
- Step 3: After receiving the results of the prize opening, based on the list of prize numbers of each lottery agent and the summary of the prize numbers established by the lottery company, the lottery company determines the value of the winning ticket in the period and withdraws the winning ticket stub (for tickets or parts that have been withdrawn at the headquarters of the lottery company).
The drawing of winning ticket stubs or determination of winning value must be recorded in writing and signed by members of the Lottery Supervision Council. The remaining ticket stubs (the ticket stubs of the non-winning tickets that have been withdrawn at the headquarters of the lottery company) must be sealed again before being put into the archives.
(2) According to the request, the manager of the lottery company shall specify the time when lottery agents must submit the list and ticket stub or the part of the lottery ticket to ensure that the ticket withdrawal must be completed at least 15 minutes before the start of the lottery.
In case the lottery agent submits the ticket late compared to the stipulated time, the lottery company has the right to refuse to accept it, and the lottery agent is responsible for paying the value of prizes sold to customers but has not yet submitted ticket stubs or stored partss to the lottery company.
(3) The entire process from step 2 to step 3 must be supervised by the Lottery Supervision Council.
(4) The lottery company must arrange a ticket counting area to ensure that it is isolated and does not allow anyone to enter or leave during the time of counting tickets, drawing prizes for winning tickets, and meeting with the Lottery Supervision Council. The ant lottery company is not allowed to install or arrange audio-visual equipment to directly monitor the lottery results during the time of recalling, counting, and withdrawing winning tickets.
(5) Based on the work steps specified in (1), (2), (3), and (4) of this section, the lottery company shall build and promulgate regulations detailing the process of withdrawing ticket stubs or manual lottery tickets.
