The Procedures for unlocking e-identification in Vietnam according to Article 30 of Decree 69/2024/ND-CP are as follows:
- The e-identification and authentication system will automatically review, check, and unlock the e-identification when there is no longer a basis for locking it.
- The person whose e-identification has been locked can request to unlock it directly at the commune-level police station (commune, ward, commune-level town) or at the provincial-level or district-level identity management authority at the nearest location, or through the national identification application using form TK03 issued alongside Decree 69/2024/ND-CP.
The identity management authority is responsible for recording, checking, authenticating, and unlocking the e-identification immediately after receiving the unlocking request from the citizen through the e-identification and authentication system.
- Judicial authorities, other competent authorities must send a written request to unlock the e-identification to the commune-level police (commune, ward, commune-level town) or the provincial-level or district-level identity management authority at the nearest location for processing.
- Within 1 working day from the date of receipt of the unlocking request from the judicial authority or other competent authority, the commune-level police or provincial/district identity management authority must review and forward the request to the head of the identity management body within the Ministry of Public Security (Hanoi, Vietnam) for consideration and approval through the e-identification and authentication system.
- Within 2 working days from the date of receipt of the proposal forwarded by the commune-level police or provincial/district identity management authority, the head of the identity management department under the Ministry of Public Security (Hanoi, Vietnam) will review, approve the unlocking request as stipulated in Clause 2, Article 30 of Decree 69/2024/ND-CP, and notify the requesting authority and the citizen. In case of denial, a written response must be provided stating the reasons.
The procedures for locking e-identification in Vietnam according to Article 29 of Decree 69/2024/ND-CP are as follows:
The e-identification and authentication system will automatically record, check, authenticate, and lock the e-identification in the cases stipulated in points b, c, d Clause 1 Article 34 of the Identification Law 2023. This recording is performed by updating the information into the e-identification and authentication system as stipulated in Article 8 of Decree 69/2024/ND-CP.
- The holder of the e-identification can request to lock the identification directly at the commune-level police (commune, ward, commune-level town) or the provincial-level or district-level identity management authority at the nearest location, or through the national identification application using form TK03 issued alongside Decree 69/2024/ND-CP. The identity management authority is responsible for recording, checking, authenticating, and locking the e-identification immediately after receiving the locking request from the citizen through the e-identification and authentication system.
- Judicial authorities, other competent authorities must send a written request to lock the e-identification to the commune-level police (commune, ward, commune-level town) or the provincial-level or district-level identity management authority at the nearest location for processing.
- Within 1 working day from the date of receipt of the locking request from the judicial authority, other competent authority, the commune-level police or provincial/district identity management authority must review and forward the request to the head of the identity management body within the Ministry of Public Security (Hanoi, Vietnam) for consideration and approval through the e-identification and authentication system.
