Regarding this issue, LawNet responded as follows:
According to Article 7 of Decree 70/2019/ND-CP, the selection of itizens to join the People's Police Force shall follow the following steps:
- Commune-level police, based on the number of citizens to perform the obligation to join the People's Police assigned in the commune, conduct:
+ Advise the People's Committee of the same level to organize announcements and propaganda on the mass media and publicly post them at the headquarters of the Police, the People's Committees of communes on subjects, criteria, conditions and time for receiving application dossiers. The time limit for receiving recruitment application dossiers is at least 30 days from the date of notification;
+ Receive dossiers of citizens applying for recruitment and organize pre-qualification (height, weight, body shape); report the results (attached to the dossier) of the qualified cases through the pre-qualification to the district-level police station;
- District-level police shall select and call citizens to perform the obligation to join the People's Police, as follows:
+ The head of the district-level police department shall issue an order to call a citizen for a medical examination according to the provisions of Clause 2, Article 40 of the Law on Military Service 2015. The order for a medical examination must be delivered to the citizen fifteen days before the time of the medical examination;
+ Organize background checks and draw conclusions on political criteria for cases meeting health standards according to the conclusions of the district health examination council;
+ Report to the Military Service Council and submit it to the President of the district-level People's Committee for decision on the list of citizens selected to perform the obligation to join the People's Police;
+ Based on the list of citizens selected to perform the obligation to join the People's Police, approved by the President of the district-level People's Committee, the head of the district-level police station shall issue an order to call each citizen to perform the obligation to join the People's Police.
Selected subjects and times to serve the People's Police Service according to Article 4 of Decree 70/2019/ND-CP are as follows:
- Male citizens of enlistment age have registered for military service in accordance with the Law on Military Service 2015. Female citizens of enlistment age who have registered for military service according to the provisions of the Law on Military Service 2015, have professional qualifications suitable to the requirements of the People's Public Security, if they voluntarily apply and the People's Public Security has the demand, shall be considered and selected to perform the obligation to join the People's Police.
- The Minister of Public Security shall specify the age for selection of citizens to perform the obligation to join the People's Police in accordance with the nature and characteristics of each employing unit and stipulate the necessary professions to select female citizens to perform the obligation to join the People's Police in accordance with the needs of use in each period.
- The time limit for performing the obligation to join the People's Police is 24 months. The Minister of Public Security shall decide to extend the period of active duty service of non-commissioned officers and conscripts, but it shall not exceed 06 months in the cases specified in Clause 1, Article 8 of the Law on People's Public Security 2018.
The time to perform the obligation is counted from the date of delivery by the citizen; in the case of not delivering and receiving, it will be counted from the date of receipt by the People's Public Security Unit until it is decided to discharge from the army by a competent authority. The time of desertion and the time of serving the prison sentence shall not be included in the time of performing the obligation to join the People's Police.
