1. Procedures for seizing and returning the ID certificate in Vietnam

The procedures for seizing and returning the ID certificate in Vietnam are defined in Article 35 of Decree 70/2024/ND-CP as follows:

  • The competent authority retaining the ID certificate must maintain records on the retention and return of ID certificate and must have the signatures of both the person retaining and the person whose identity certificate is temporarily retained.

  • During the period the identity certificate is retained, if the individual requires the use of their identity certificate for transactions or to exercise their lawful rights and interests, they must submit a written request to the authority retaining the identity certificate for consideration and decision.

2. Procedures for revoking ID certificate in Vietnam

The procedures for revoking ID certificate in Vietnam are defined in Article 34 of Decree 70/2024/ND-CP as follows:

  • The procedures for revoking ID certificate of individuals of Vietnamese origin who have not confirmed their nationality but are granted Vietnamese nationality or confirmed to have Vietnamese nationality or another foreign nationality.

    • Within 30 days from the date of the decision granting Vietnamese nationality or confirming Vietnamese nationality for individuals of Vietnamese origin who have not confirmed their nationality, the Ministry of Justice (or the Department of Justice, in cases of confirming Vietnamese nationality) must notify the identity management authority of the Ministry of Public Security.

    • Within 3 working days from the receipt of the notification from the Ministry of Justice, the identity management authority of the Ministry of Public Security must revoke and invalidate the ID certificate issued to individuals of Vietnamese origin who have not confirmed their nationality and update, adjust the information of these individuals in the National Database on Population and the Identity Database.

    • Within 3 working days from having the grounds for determining that individuals of Vietnamese origin who have not confirmed their nationality are granted Vietnamese nationality, or confirmed to have Vietnamese nationality, or another foreign nationality, the identity management authority must revoke, invalidate the ID certificate and update, adjust information in the National Database on Population and the Identity Database.

  • The procedures for revoking incorrectly issued ID certificate or altered, forged ID certificate.

    • When there are grounds to determine that an identity certificate was issued incorrectly or has been altered or forged, the agencies, organizations, or individuals must notify the identity management authority of the district or provincial police for verification and require the holders to surrender the ID certificate.

    • Within 7 working days, the identity management authority of the district or provincial police must verify and revoke the incorrectly issued or altered, forged ID certificate and update, adjust the information in the National Database on Population and the Identity Database.

  • In cases where the identity certificate cannot be retrieved, the identity management authority will still update the information as per Point b and Point c, Clause 1, Article 34 of Decree 70/2024/ND-CP.
