Procedures for renewing the Establishment Registration Certificate of an establishment providing domestic violence prevention support services in Vietnam (Internet image)

Regarding this issue, LawNet would like to answer as follows:

Procedures for renewing the Establishment Registration Certificate of an establishment providing domestic violence prevention support services are specified in Decision 3657/QD-BVHTTDL 2023 as follows:

1. Application for renewal of Certificate of establishment registration of an establishment providing domestic violence prevention support services in Vietnam

* Number of documents: 01 (set).

* Profile components:

(1) In case of change of address or change of content and scope of activities, the dossier includes an application for renewal of the certificate of establishment of a facility providing domestic violence prevention and control services.

(2) In case of changing the head, the dossier includes:

- Application for renewal of the certificate of registration to establish a facility providing support services for domestic violence prevention and control according to Form No. 15 of the Appendix issued with Decree 76;

- Profile of the head: (1) A health examination certificate from a competent medical facility according to the law on health examination; (2) A notarized copy of a university degree or higher in the field or training major related to the service registered to provide; (3) Notarized or authenticated copies of diplomas, certificates, and other certifications related to establishment registration services; (4) A commitment that you have not been prosecuted for criminal liability or have not been sanctioned for administrative violations in the field of domestic violence prevention and control according to Form No. 16 of the Appendix issued together with Decree 76/2023/ND-CP;

* How to submit application:

- Submit 01 set of documents, either directly or by post or electronically (via the National Public Service Portal), to the specialized agency on culture, sports, and tourism of the Provincial People's Committee (Department of Culture, Sports, and Tourism/Department of Culture and Sports of the province or city) where the facility is located.

- In case of electronic submission, the dossier components as sent directly are taken (from the original) or in digitally signed PDF format. The document name is set to correspond to the name of the attached paper or document.

2. Procedures for renewing the Establishment Registration Certificate of an establishment providing domestic violence prevention support services in Vietnam

- When the facility providing support services for domestic violence prevention and control changes its head, address, content, and scope of activities, then send a request for renewal of the certificate of establishment registration to establish a domestic violence prevention and control support facility according to Form No. 15 of the appendix issued with Decree 76/2023/ND-CP to the specialized agency on culture, sports, and tourism of the Provincial People's Committee (Department of Culture, Sports, and Tourism/Department of Culture and Sports of the province or city) where it is headquartered.

- In case the application is invalid, within 05 working days from the date of receipt, the receiving agency shall notify the applicant in writing to complete it;

- Within 10 working days from the date of receiving a valid application, the application-receiving agency shall issue a replacement certificate to the facility providing domestic violence prevention and control services according to Form No. 17 of the Appendix issued with Decree 76/2023/ND-CP. In the event of a refusal to issue a certificate, a written response must be provided clearly stating the reason.

3. Conditions for heads of establishments providing domestic violence prevention support services

- Have good health as concluded by a competent medical facility according to the provisions of the law on health examinations.

- Have not been prosecuted for criminal liability or have not been sanctioned for administrative violations in the field of domestic violence prevention and control.

- Degree from a university or higher in a major, industry group, or training field related to the service registered to participate in is specified as follows:

+ For establishments providing consulting services on domestic violence prevention and control: The head of the establishment has a university degree or higher in teacher training; health industry; psychology; law ; sociology; community service;

+ For establishments providing shelter services for people suffering from domestic violence: the head of the establishment has a university degree or higher;

+ For establishments providing educational services and supporting the conversion of domestic violence behavior: the head of the establishment has a university degree or higher in teacher training; health industry; psychology; the law; sociology; community service;

+ For facilities providing health care and mental illness prevention services for people suffering from domestic violence: The head of the facility has a university degree or higher in teacher training; health industry; psychology; sociology; community service;

+ For establishments providing other services related to domestic violence prevention and control: the head of the establishment has a university degree or higher in the industry, industry group, or field appropriate to the service provided.

- In case an establishment registers to provide many of the operational services specified in Clause 1 of Article 40 of the Law on Prevention and Combat against of Domestic Violence, the head must meet health requirements, not be prosecuted for criminal liability, not have been sanctioned for administrative violations in the field of domestic violence prevention and control, and have at least one of the qualifications specified above.
