Regarding this issue, LawNet would like to answer as follows:
Specifically, Article 10 of Circular 09/2015/TT-BTTTT regulates procedures for registering organizations for support activities through the National Humanitarian Electronic Information Portal (Portal 1400) as follows:
(1) Registration documents include:
- Application for organizing support activities through Portal 1400 according to Form 01/ĐN attached to Circular 09/2015/TT-BTTTT;
- Certified copy (if submitting the application by post) or photocopy (bring the original for comparison if submitting the application directly at the application receiving address). Decision on the establishment of an agency or organization;
- Plan to organize support activities through Portal 1400.
(2) Plan to organize support activities through Portal 1400 includes at least the following contents:
- Purpose of the support campaign;
- Start and end times of the support campaign;
- Plan to use messaging service numbers and support the value of messages;
- Specific communication plan to mobilize people and telecommunications subscribers to participate in support activities.
(3) Address and deadline for receiving registration documents
- Registration documents must be sent to VTC Corporation at least 15 (fifteen) working days before the start of the support campaign.
- For dossiers requesting the use of Portal 1400 for the purpose of serving important socio-political events in the country,
The registration dossier must be sent to the Department of Telecommunications at least 20 (twenty) working days before the start of the support campaign.
(4) Deadline and process for processing documents
- Within 05 (five) working days from the date of receiving the valid dossier, VTC Corporation is responsible for evaluating the dossier; issuing a Decision to open Portal 1400 to serve the support campaign, and sending the Decision to open Portal 1400 to the agency in charge of organizing the support campaign and relevant telecommunications businesses.
In the event of refusing the request to open Portal 1400, VTC Corporation will send a written response to the agency in charge of organizing the support activity, clearly stating the reason for the refusal.
- For dossiers requesting the use of Portal 1400 for the purpose of serving important socio-political events of the country, within 10 (ten) working days from the date of receiving the valid dossier, the Telecommunications Department is responsible for evaluating the dossier and submitting it to the Ministry of Information and Communications for consideration and decision.
Based on the approval of the Ministry of Information and Communications, the Department of Telecommunications issued a Decision to open Portal 1400 to serve the support campaign and sent the Decision to open Portal 1400 to the agency in charge of organizing the support campaign, relevant telecommunications enterprises, and VTC Corporation.
In the event of a refusal of the request to open Portal 1400, the Department of Telecommunications will send a written response to the agency in charge of organizing the support activity and clearly state the reason for the refusal.
(5) The decision to open Portal 1400 to serve each support campaign includes the following basic contents:
- Name of the agency organizing the support campaign through Portal 1400;
- Opening and closing times of Portal 1400;
- The number of the messaging service and the support value of the message corresponding to the number of the messaging service;
- Content (syntax) of support message;
- Other related information (if any).
Support activities through the National Humanitarian Electronic Information Portal must comply with the principles specified in Article 3 of Circular 09/2015/TT-BTTTT, specifically as follows:
- Agencies and organizations (hereinafter referred to as agencies) organizing support activities preside over the implementation of a campaign to mobilize telecommunications subscribers to send money for support (hereinafter referred to as a support campaign) in accordance with the provisions of law on mobilization, receipt, distribution, and use of voluntary contributions for humanitarian and charitable purposes.
- Port 1400 is a telecommunications equipment system set up by the Ministry of Information and Communications to receive donation messages from telecommunications subscribers nationwide; it operates for non-profit purposes on the basis of revenue to cover expenses; it has independent accounting; it ensures accuracy, transparency, publicity, and convenience.
- Telecommunications businesses create an additional convenient and quick contribution channel for support activities by providing text messaging services through Port 1400 to telecommunications subscribers on a commercial basis with reasonable profits.
- Telecommunications subscribers contribute money through Cong 1400 on a voluntary basis with an unlimited number of support messages for each support campaign.
