Regarding this issue, LawNet would like to answer as follows:

Procedures for recertifying inspectors of inland waterway vehicles in Vietnam as of March 20, 2024, are specified in Decision 194/QD-BGTVT of 2024 as follows:

1. Application for recertifying inspectors of inland waterway vehicles in Vietnam as of March 20, 2024

* The application includes:

- Application form from the registration unit according to the original form;

- Inspectors' professional resume according to the sample (original) if there are any changes compared to the first inspectors' accreditation record.

* Number of documents: 01 set.

* Submission:

- Submit application directly; or

- Through the postal system; or

- Through the online public service portal.

2. Procedures for recertifying inspectors of inland waterway vehicles in Vietnam as of March 20, 2024

* Step 1: Submit application

The registration unit submits the application to the Vietnam Register.

* Step 2: Proceed the application

- Vietnam Register receives and checks the documents; Within 01 (one) working day from the date of receipt of the dossier, if the dossier is incomplete, instruct the registry unit to supplement it according to regulations.

- In case the Inspectors' Certificate has expired but not more than 12 (twelve) months, then within 03 (three) working days from receipt of complete documents as prescribed, the Council for Recognizing Inspectors requests the Director of the Vietnam Register decide to recertify inspectors and issue a Certificate of Inspectors.

- In the following cases: the inspectors' certificate has expired for more than 12 (twelve) months; recertification for inspectors suggests adding the scope and type of inspection but does not change the class of inspectors; Inspectors have their certificates revoked, and the recertification procedure is as follows:

(1) Vietnam Register receives and checks the documents; Within 01 (one) working day from the date of receipt of the dossier, if the dossier is incomplete, instruct the registry unit to supplement it according to regulations.

(2) Within 05 (five) working days from the date of receiving complete documents as prescribed, the Vietnam Register agrees with the registration unit on time, location and assignment of inspectors to conduct a practical examination of the professional practice capacity of those proposed to be recognized as inspectors.

Within 05 (five) working days after completing the actual inspection of the professional practice capacity of the person proposed to be recognized as an inspector, inspectors and registration units must complete a record of the actual inspection of the inspector's professional practice capacity.

The time to complete the actual inspection of professional practice capacity is a maximum 03 (three) months from the date of receipt of complete documents, according to regulations.

(3) Within 03 (three) working days after the Vietnam Register receives the inspection record, the Council recognizes inspectors based on inspectors' standards and the results of actual inspections of professional practice capacity:

- If satisfactory, request the Director of the Vietnam Register to decide whether to recognize inspectors and issue a Certificate of inspector;

- If the requirements are not met, notify the registration unit in writing to request the accreditation of inspectors.

(4) The registration unit has the right to request the Vietnam Register to re-check the professional competency of the person proposed to be recognized as an inspector after a minimum period of 01 (one) month from the date of the failed inspection. The registration unit submits 01 application from the registration unit according to the form to the Vietnam Register. The Vietnam Register carries out the order and procedures for recognizing inspectors according to the provisions in sections (2) and (3) above.
