Regarding this issue, LawNet would like to answer as follows:
A community library is a library that possesses consolidated information resources and was established by a residential community at a commune-level cultural - sports center, community learning center, post office providing cultural services, cultural center, an apartment building or in a common space of the community.
(Clause 1, Article 16 of the Library Law 2019)
Procedures for notification of library establishments for community libraries are guided in Decision 4005/QD-BVHTTDL 2023 as follows:
Documents announcing the establishment of a library for a community library include:
- Notice of library establishment (for community libraries/Private libraries serving the community) (according to Form No. 01 specified in Appendix VIII issued with Circular 13/2023/TT-BVHTTDL amending regulations related to citizenship documents in a number of Circulars issued by the Minister of Culture, Sports, and Tourism).
- Documents proving eligibility for establishment as prescribed in Clause 1, Article 18 of the Library Law 2019, Article 20 of Decree 93/2020/ND-CP detailing a number of articles of the Library Law 2019.
- 30 days before the date the library opens for operation, the organization or individual establishing the library shall send a notice of establishment to the People's Committee of the commune where the library is headquartered.
- Within 15 days from the date of receipt of complete and valid notification documents, the Commune-level People's Committee must respond in writing; In cases of disagreement, the reason must be clearly stated. Within 10 days from the date of receipt of the notification, if the notification dossier does not have enough documents as prescribed, the commune-level People's Committee is responsible for sending documents requesting agencies, organizations, and individuals to supplement or adjust records.
Procedures for notification of merger, consolidation, division, and separation of libraries for community libraries are guided in Decision 4005/QD-BVHTTDL in 2023 as follows:
- Notice of merger/consolidation/division/separation of libraries (according to Form No. 04 specified in Appendix VIII issued with Circular 13/2023/TT-BVHTTDL amending regulations related to citizenship documents in a number of Circulars issued by the Minister of Culture, Sports and Tourism).
- Documents proving eligibility for establishment as prescribed in Clause 1, Article 18 of the Library Law 2019, Article 20 of Decree 93/2020/ND-CP detailing a number of articles of the Library Law 2019
- 30 days before the date the library merges, consolidates, divides, or separates, the organization or individual establishing the library shall send a notice to the People's Committee of the commune where the library is headquartered.
- Within 15 days from the date of receipt of complete and valid notification documents, the Commune-level People's Committee must respond in writing; In cases of disagreement, the reason must be clearly stated. Within 10 days from the date of receipt of the notification, if the notification dossier does not have enough documents as prescribed, the commune-level People's Committee is responsible for sending documents requesting agencies, organizations, and individuals to supplement or adjust records.
