Regarding this matter, LawNet would like to answer as follows:
The procedures for issuing certificates of eligibility for doing the sports business for Paragliding and Kite Flying in Vietnam are regulated in Decision 775/QD-BVHTTDL in 2024 as follows:
- The application for issuing certificates of eligibility for doing the sports business (according to Form 02 in Appendix III of Decree 31/2024/ND-CP dated March 15, 2024).
- Certified copy of the business registration certificate.
- Summary of the preparations for business conditions (according to Form 3 in the Appendix of Decree 36/2019/ND-CP dated April 29, 2019), including:
- Number of sets: (01) set.
- Submission methods: Submitting documents by post, electronic means, or in-person.
- Businesses submit documents by post, electronic means, or in-person to the specialized sports agency under the People's Committee at the provincial level where the sports business is registered or where the business has its main office if there are multiple locations for sports business operations.
- The specialized sports agency under the provincial People's Committee (hereinafter referred to as the issuing authority) provides the business with an acknowledgement of receipt for the documents.
- In the event that the documents need to be modified or supplemented, the issuing authority directly informs the business or provides written notification of the necessary changes within a period of 03 working days from the date of receiving the documents.
(1) Training, competition, and performance facilities
* Take-off and landing areas that meet the following requirements:
- The height difference between the take-off area and the landing area is at least 70 meters.
- Size of the take-off area:
+ For Paragliding, at least 15 meters horizontally and 10 meters vertically.
+ For Kite Flying, at least 10 meters horizontally and 10 meters vertically.
- Size of the landing area:
+ For Paragliding, at least 30 meters horizontally and 30 meters vertically.
+ For Kite Flying, at least 15 meters horizontally and 60 meters vertically.
* Suitable wind conditions for take-off:
- For low-level paragliding (EN A, EN B level), the wind speed is 0-5.5 m/s.
- For high-level paragliding, competition paragliding, the wind speed is 0–8.8 m/s.
- For non-motorized kite flying, the wind speed is 6.6–8.8 m/s.
- For motorized kite flying, the wind speed is 0–8.8 m/s.
* Internal regulations and signage placed in easily visible positions in the take-off and landing areas, including:
- Internal regulations specifying: training and competition hours, eligible participants for training, competition, and performance; ineligible participants for training, competition, and performance; training, competition, and performance attire; safety measures during training and competition, and other regulations.
- Signage specifying: flight area maps, flight area boundaries, flight area regulations, contact information for responsible flight management personnel, walkie-talkie frequency, and communication procedures when necessary.
* Safety, search, and rescue plans
- The plan must specify safety, search, and rescue measures within the flight operating area under the management responsibility of the facility, and must be regularly reviewed and updated.
- Participants in Paragliding and Kite Flying activities must be informed and instructed on the flight plan to understand communication methods and sequence of search and rescue steps.
(2) Training, competition, and performance equipment
- Main and reserve parachutes (for Paragliding) and kites, reserve kites (for Kite Flying), harnesses, safety systems, walkie-talkies, helmets, shoes, altitude measuring devices, and global positioning systems.
- There must be communication means that ensure uninterrupted communication requirements from the operational department to the flight management of the paragliding and kite flying activity areas within the management responsibility of the sports facility and the relevant authorities.
- Paragliding and Kite Flying activities must be conducted in a manner that is compatible with the customs, practices, and cultural traditions of the ethnic community.
(3) Flight frequency and training density
* The minimum time between takeoffs is 90 seconds.
* Training instruction density:
- Each training instructor must ensure:
+ Instruction for no more than 05 people in one hour of training;
+ Flying together with no more than 01 person per flight.
* An individual in training should not exceed 2 flights per session.
(4) Specific conditions for businesses engaged in extreme sports activities:
- Business households and other organizations wishing to engage in extreme sports activities must register for business establishments.
- Businesses engaged in extreme sports activities listed in the List of Extreme Sports Activities regulated by the Minister of Culture, Sports, and Tourism must meet the following conditions:
(5) Professional personnel:
- Sports training instructors must meet one of the following conditions:
+ Be a coach or athlete with a level 2 or higher certification or equivalent suitable for the registered sports activity;
+ Have a diploma in sports from a secondary level or higher, suitable for the registered sports activity;
+ Receive specialized sports training as prescribed by the Minister of Culture, Sports, and Tourism.
- Rescue personnel;
- On-duty medical personnel or a written agreement with the nearest medical facility regarding medical personnel for first aid and emergency treatment for participants in extreme sports activities when necessary.
