Regarding this matter, LawNet would like to answer as follows:
The procedures for issuing certificates of eligibility for conducting sports business for sport diving are stipulated in Decision 775/QD-BVHTTDL in 2024 as follows:
- Documents include:
(1) Request form for issuing certificates of eligibility for conducting sports business (according to Form 02 in Appendix III of Decree 31/2024/ND-CP dated March 15, 2024)
(2) Copy of the business registration certificate;
(3) Summary of the preparation of business conditions (according to Form 3 in Appendix of Decree 36/2019/ND-CP dated April 29, 2019), including:
- Number of sets of documents: (01) set.
- Submission methods: Submit documents by post, electronically, or in person.
- Enterprises submit documents by post, electronically, or in person to the specialized agency for physical education and sports under the People's Committee at the provincial level where the sports business location is registered or where the enterprise has its main office in case the enterprise has multiple sports business locations.
- The specialized agency for physical education and sports under the provincial People's Committee (hereinafter referred to as the Certificate-issuing agency) issues a receipt for the submitted documents to the enterprise.
- In case the documents need to be amended or supplemented, the Certificate-issuing agency directly informs or notifies the enterprise in writing of the necessary amendments or supplements within a period of 03 working days from the date of receiving the documents.
(1) Infrastructure
- The coastal diving area must have a complete system of buoys and signs that are properly positioned on nautical charts. The buoys and signs must have contrasting colors with the water and the surrounding environment for easy observation.
- There must be inland watercraft for transporting divers, training instructors, rescue personnel, and recreational diving equipment.
- There must be an area for gathering inland watercraft and mooring them.
- There must be changing rooms, storage facilities, bathrooms, and sanitation areas for divers; there must also be first aid kits as required by the Ministry of Health.
- There must be a logbook for divers that includes the following main information: full name, identity card or citizen identity card number, health status of the diver, address, and contact number when necessary.
- There must be a diving regulations board that specifies the following main content: training hours, prohibited participants, attire for participation, and safety measures.
(2) Equipment
- Personal protective equipment for divers and training instructors: compressed air tanks, compressed gas cylinders, oxygen cylinders, positioning devices, pressure gauges, depth gauges, temperature gauges, dive timers, diving suits, lead belts, fins, goggles, breathing tubes, valve systems, and air supply tubes to the mouthpiece, lifebuoys.
- Communication systems that ensure continuous connection between the local search and rescue center and the operating areas within the facility's management scope.
(3) Safety assurance
- When there are divers underwater, inland watercraft conducting diving activities must hoist a signal flag to ensure the safety of the divers.
- Training instructors must instruct divers on how to use air tanks, diving equipment, lifebuoys, and diving techniques.
- Divers are responsible for declaring their health status according to the regulations of the sports facility and are responsible for their own declarations.
(4) There must be a motorized rescue boat.
(5) Training density
Each training instructor can only guide up to 01 diver at a time.
(6) Specific conditions for adventure sports business operations:
- Business households and other organizations wishing to engage in adventure sports activities must register and establish a business.
- Adventure sports business operations listed in the List of Adventure Sports Activities regulated by the Minister of Culture, Sports, and Tourism must meet the following conditions:
(7) Professional personnel, including:
- Sports training instructors must meet one of the following conditions:
+ Being a coach or athlete with a level 2 or higher certification or an equivalent qualification suitable for the registered business sports activity.
+ Having a diploma in sports from an intermediate level or higher, suitable for the registered business sports activity.
+ Receiving sports training according to the regulations of the Minister of Culture, Sports, and Tourism.
- Rescue staff;
- On-duty medical staff or an agreement with the nearest medical facility regarding medical staff for first aid and emergency treatment of participants in adventure sports activities when necessary.
