Regarding this matter, LawNet would like to answer as follows:
The procedures for issuing certificates of eligibility for conducting sports business for Sport Climbing are stipulated in Decision 775/QD-BVHTTDL in 2024 as follows:
- Documents include:
(1) Request form for issuing certificates of eligibility for conducting sports business (according to Form 02 in Appendix III of Decree 31/2024/ND-CP dated March 15, 2024)
(2) Copy of the business registration certificate;
(3) Summary of the preparation of business conditions (according to Form 3 in Appendix of Decree 36/2019/ND-CP dated April 29, 2019), including:
- Number of sets of documents: (01) set.
- Submission methods: Submit documents by post, electronically, or in person.
- Enterprises submit documents by post, electronically, or in person to the specialized agency for physical education and sports under the People's Committee at the provincial level where the sports business location is registered or where the enterprise has its main office in case the enterprise has multiple sports business locations.
- The specialized agency for physical education and sports under the provincial People's Committee (hereinafter referred to as the Certificate-issuing agency) issues a receipt for the submitted documents to the enterprise.
- In case the documents need to be amended or supplemented, the Certificate-issuing agency directly informs or notifies the enterprise in writing of the necessary amendments or supplements within a period of 03 working days from the date of receiving the documents.
(1) Infrastructure for training and competition in artificial rock climbing:
1. Climbing walls
a) Climbing walls for lead climbing and top-rope climbing:
- Ensure a minimum height of 4.5m for training purposes;
- Ensure a minimum height of 8m for provincial, city, and club-level competitions;
- Ensure a minimum height of 12m for national-level competitions.
b) Climbing walls for bouldering:
- Height should not exceed 4.5m and should have protective padding on the ground;
- For walls with a height of 3m or less: Ground padding should be at least 12cm thick and have elasticity;
- For walls with a height between 3m and 4.5m: Ground padding should be at least 20cm thick and have elasticity.
2. Climbing holds should be securely fastened and not loose or rotating, following the standards of the International Climbing and Mountaineering Federation.
3. The structural frame of climbing walls should be able to withstand the load of the entire wall and the forces exerted by climbers.
4. There should be regulations regarding training hours, training attire, and safety measures during training and competition.
5. There should be sanitary facilities, changing rooms, and storage areas for personal belongings of the climbers.
(2) Infrastructure for training and competition in natural rock climbing:
1. Rock faces
a) Rock faces for lead climbing and top-rope climbing:
Pre-set climbing routes on the rock face, with safety anchors installed according to the manufacturer's instructions and international standards of the International Climbing and Mountaineering Federation.
b) Rock faces for bouldering:
- Ensure a height not exceeding 4.5m and have protective padding on flat terrain;
- For heights of 3m or less: Ground padding should be at least 12cm thick and have elasticity;
- For heights between 3m and 4.5m: Ground padding should be at least 20cm thick and have elasticity.
2. There should be regulations displayed in visible locations within the climbing area, specifying training hours, training attire, safety measures, and contact information of the responsible person for climbing management when necessary. The content of the regulations should include maps of the climbing area, boundary markings, and contact information.
(3) Training and competition equipment:
1. Specialized mountaineering and climbing shoes, climbing ropes, harnesses, carabiners, belay devices, carabiner locking devices, specialized helmets, chalk bags, and additional equipment specific to the type of mountaineering and climbing. All mountaineering and climbing equipment should meet the standards of the International Climbing and Mountaineering Federation.
2. Ensuring communication between climbers, training instructors, and the operational department at the training and competition locations, as well as access to medical facilities.
(4) Training density, instruction, and rescue:
1. Each training instructor should not exceed 15 climbers per hour.
2. There should be full-time rescue personnel, with one rescue staff member allocated for every 15 climbers.
(5) Special requirements for sports business for sport required training instructors:
a) Household businesses and other organizations involved in sports activities required training instructors must carry out business registration.
b) Sports businesses that provide training instruction or sports businesses listed in the list of sports required training instructors, as regulated by the Minister of Culture, Sports, and Tourism, must meet the following conditions:
c) The professional staff of sports businesses should include:
- Sports training instructors who meet one of the following conditions:
+ Coaches or athletes with a minimum level of rank 2 or equivalent, suitable for the registered sports activity;
+ Holders of diplomas in sports education from intermediate level or higher, suitable for the registered sports activity;
+ Having received specialized sports training according to the regulations of the Minister of Culture, Sports, and Tourism.
(6) Special requirements for adventure sports businesses:
a) Businesses and other organizations providing adventure sports activities must carry out business registration.
b) Adventure sports businesses listed in the list of sports required training instructors, as regulated by the Minister of Culture, Sports, and Tourism, must meet the following conditions:
c) The business should have sufficient professional staff, including:
- Sports training instructors who meet one of the following conditions:
+ Coaches or athletes with a minimum level of rank 2 or equivalent, suitable for the registered sports activity;
+ Holders of diplomas in sports education from intermediate level or higher, suitable for the registered sports activity;
+ Having received specialized sports training according to the regulations of the Minister of Culture, Sports, and Tourism.
- Rescue staff.
- On-site medical staff or a written agreement with the nearest medical facility to provide medical assistance and emergency care to participants involved in adventure sports activities when necessary.
