Procedures for issuing certificates of eligibility for conducting sports business for Jet skiing in Vietnam (Internet image) 

Regarding this matter, LawNet would like to answer as follows: 

The procedures for issuing certificates of eligibility for conducting sports business for Jet skiing are stipulated in Decision 775/QD-BVHTTDL in 2024 as follows:

1. Documents for issuing certificates of eligibility for conducting sports business for Jet skiing in Vietnam 

- Documents include:

(1) Request form for issuing certificates of eligibility for conducting sports business (according to Form 02 in Appendix III of Decree 31/2024/ND-CP dated March 15, 2024)

(2) Copy of the business registration certificate;

(3) Summary of the preparation of business conditions (according to Form 3 in Appendix of Decree 36/2019/ND-CP dated April 29, 2019), including:

- Number of sets of documents: (01) set.

- Submission methods: Submit documents by post, electronically, or in person.

2. Procedures for issuing certificates of eligibility for conducting sports business for Jet skiing in Vietnam

- Enterprises submit documents by post, electronically, or in person to the specialized agency for physical education and sports under the People's Committee at the provincial level where the sports business location is registered or where the enterprise has its main office in case the enterprise has multiple sports business locations.

- The specialized agency for physical education and sports under the provincial People's Committee (hereinafter referred to as the Certificate-issuing agency) issues a receipt for the submitted documents to the enterprise.

- In case the documents need to be amended or supplemented, the Certificate-issuing agency directly informs or notifies the enterprise in writing of the necessary amendments or supplements within a period of 03 working days from the date of receiving the documents.

3. Conditions for issuing certificates of eligibility for conducting sports business for Jet skiing in Vietnam 

(1) Infrastructure

* Jet ski activity areas must meet the following requirements:

- They must be determined by a system of floating buoys and marker flags;

- The floating buoys and marker flags must have contrasting colors to the water and the surrounding environment for easy observation; the maximum distance between each buoy and marker flag is 50m. The floating buoys are spherical with a minimum diameter of 30cm; the materials used for the buoys must not cause environmental pollution. The marker flags are rectangular, with dimensions of 25cm x 30cm;

- The water depth must be at least 2m, with no underwater rocks, coral reefs, offshore structures, bathing areas, or other obstacles;

- The distance from the water edge of the beach to the outer limit of the activity area is a maximum of 650m, and to the inner limit of the activity area is a minimum of 60m.

* The distance between the entrance and exit of each jet ski docking berth must be at least 250m. The entrance and exit of the jet ski docking berths must have a minimum width of 6m.

* There must be sanitary facilities, changing rooms, and storage areas for the personal belongings of participants; there must be first aid kits and initial emergency rescue equipment suitable for training, performances, and competitions of jet ski sports on the sea.

* There must be a set of rules displayed in easily visible locations within the starting area, entrance, and exit of the jet ski docking berths.

The set of rules specifies the following main contents: training hours; individuals not allowed to participate in training, competitions, and performances; training, competition, and performance attire; safety measures during training, performances, and competitions; prohibition of controlling vehicles outside the activity area defined by floating buoys, marker flags, and other regulations.

(2) Equipment

* The jet ski engine must have a horsepower rating suitable for the technical design of the vehicle.

* Jet skis used for activities must meet quality, technical safety, and environmental protection standards as prescribed by law.

* Communication and rescue information

- The information system must ensure communication requirements from the management and rescue departments to the jet ski activity areas;

- The observation station must ensure full observation of the jet ski activity areas;

- There must be rescue boats; each rescue boat must have at least 5 lifebuoys;

- Each person must have at least 1 life jacket.

(3) There must be a motorized rescue boat.

(4) Training instructor density: Each sports training instructor can only instruct a maximum of 1 person at a time.

(5) Specific conditions for businesses engaged in extreme sports activities:

- Business households and other organizations wishing to engage in extreme sports activities must register and establish a business.

- Businesses engaged in extreme sports activities listed in the List of Extreme Sports Activities regulated by the Minister of Culture, Sports and Tourism must meet the following conditions:

(6) Professional personnel, including:

- Sports training instructors must meet one of the following conditions:

+ Being a coach or athlete with a level 2 or higher certification or equivalent suitable for the registered business sports activity;

+ Having a diploma in sports from an intermediate level or higher suitable for the registered business sports activity;

+ Receiving professional sports training as prescribed by the Minister of Culture, Sports, and Tourism.

- Rescue staff;

- On-duty medical staff or a written agreement with the nearest medical facility regarding medical staff for first aid and emergency treatment of participants in extreme sports activities when necessary.
