Procedures for issuing certificates of eligibility for conducting sports business for Fencing in Vietnam (Internet image) 

Regarding this matter, LawNet would like to answer as follows: 

The procedures for issuing certificates of eligibility for conducting sports business for Fencing are stipulated in Decision 775/QD-BVHTTDL in 2024 as follows:

1. Documents for issuing certificates of eligibility for conducting sports business for Fencing in Vietnam 

- Documents include:

(1) Request form for issuing certificates of eligibility for conducting sports business (according to Form 02 in Appendix III of Decree 31/2024/ND-CP dated March 15, 2024)

(2) Copy of the business registration certificate;

(3) Summary of the preparation of business conditions (according to Form 3 in Appendix of Decree 36/2019/ND-CP dated April 29, 2019), including:

- Number of sets of documents: (01) set.

- Submission methods: Submit documents by post, electronically, or in person.

2. Procedures for issuing certificates of eligibility for conducting sports business for Fencing in Vietnam

- Enterprises submit documents by post, electronically, or in person to the specialized agency for physical education and sports under the People's Committee at the provincial level where the sports business location is registered or where the enterprise has its main office in case the enterprise has multiple sports business locations.

- The specialized agency for physical education and sports under the provincial People's Committee (hereinafter referred to as the Certificate-issuing agency) issues a receipt for the submitted documents to the enterprise.

- In case the documents need to be amended or supplemented, the Certificate-issuing agency directly informs or notifies the enterprise in writing of the necessary amendments or supplements within a period of 03 working days from the date of receiving the documents.

3. Conditions for issuing certificates of eligibility for conducting sports business for Fencing in Vietnam

(1) Facilities and Training Equipment

1. The training floor should have a size of at least 20m x 10m, flat, and non-slip.

2. The lighting should ensure a brightness of at least 150 lux.

3. There should be storage space, sanitary areas, and a first aid kit as prescribed by the Ministry of Health.

4. A training participant logbook should be maintained.

5. A regulation board should be posted, including the following key contents: participants of training, training attire, training hours, safety measures during training.

6. Training equipment:

a) Protective gear made of fabric (withstanding a force of at least 350N), protective clothing for children (withstanding a force of at least 350N), masks (withstanding a force of at least 350N), electric protective clothing (for sword combat and fencing), gloves, shoes, shin guards;

b) Training swords (including sword combat, fencing, and triple-edged swords).

The management and use of swords shall comply with the regulations on the management and use of weapons, explosives, and combating tools.

(2) Facilities and Equipment for competition

1. Facilities:

a) Complying with the regulations specified in points 1 and 2 of section (1) above.

b) The piste should be made of alloy with a length ranging from 17m to 18m and a width ranging from 1.5m to 2.0m.

2. Equipment:

a) Complying with the regulations specified in point a of item 6 in section (1) above.

b) The swords, electric mask cords, electric body cords.

(3) Specific requirements for sports businesses with training instructors:

a) Business households and other organizations intending to conduct sports activities with mandatory training instructors must register the establishment of a business.

b) Sports business that provide sports training services or Sports business listed in the list of sports requiring training instructors, as regulated by the Minister of the Ministry of Culture, Sports, and Tourism, must meet the following conditions:

(4) Professional personnel: Sports training instructors must meet one of the following conditions:

+ Holding a coaching or athlete certificate with a level of 2 or higher, or equivalent, appropriate for the registered sports business activity.

+ Holding a diploma in sports from at least a secondary level or higher, appropriate for the registered sports business activity.

+ Receiving sports training according to the regulations of the Minister of the Ministry of Culture, Sports, and Tourism.
