Regarding this issue, LawNet would like to answer as follows:

Procedures for issuing a Certificate of Technical Safety and Environmental Protection for modified motor vehicles are guided in Decision 62/QD-BGTVT in 2024 as follows:

1. Application for Certificate of Technical Safety and Environmental Protection for modified motor vehicles in Vietnam

Application for Certificate of Technical Safety and Environmental Protection for modified motor vehicles includes:

- Document requesting acceptance of modified motor vehicles according to the form;

- The design has been appraised in its original form or has been appraised electronically (for design appraisal results returned through the online public service system). For cases of design exemption specified in Clause 3, Clause 4 and Clause 6, Article 6 of Circular 85/2014/TT-BGTVT, there must be an overall drawing of the motor vehicle after renovation prepared by the renovation facility;

- Overall photo taken at approximately a 45-degree angle from the front and opposite rear corners of the motor vehicle after renovation; detailed photos of systems and total renovation results;

- Factory acceptance record of modified motor vehicles;

- List of components and new replacement systems according to the form;

- Certified copy of the renovation facility's documents on parameters and technical features of modified motor vehicles and renovated and replacement components and systems, and documents confirming the origin of renovated systems and components;

- Certificate of quality and technical safety for cranes, tanks carrying dangerous goods, tanks carrying compressed air, liquefied petroleum gas, and specialized equipment according to regulations (for modified motor vehicles with the same brand, model, and technical specifications and modified by the same reconditioning facility, they can use the same design, and the inspection conducted by the same inspection agency does not require submission of this document component);

- Document from the design appraisal agency agreeing to use the appraised design for renovation construction (for modified motor vehicles with the same brand, model, and technical specifications and modified by the same reconditioning facility, they can use the same design, and the inspection conducted by the same inspection agency does not require submission of this document component).

2. Procedure for issuing Certificate of Technical Safety and Environmental Protection for modified motor vehicles

* Step 1: Submit application

Organizations and individuals submit applications for acceptance of modified motor vehicles to the Motor Vehicle Registration Unit.

* Step 2: Resolve

- The motor vehicle registration unit receives and checks the dossier. If the dossier is not complete according to regulations, it will instruct organizations and individuals to supplement and complete it within the same working day (in case of direct application) or notify and instruct them to complete the application within 02 working days (in case of submitting an application via postal system or other appropriate form);

- In case the documents are complete according to regulations, the Motor Vehicle Registration Unit will accept the modified motor vehicles. If the acceptance results meet the requirements, a Certificate of renovation will be issued to the organization or individual within 03 working days from the date of completion of acceptance.

In case of refusal, the motor vehicle registration unit shall notify the organization or individual in writing and clearly state the reason after 02 working days from the date of acceptance results;

- Organizations and individuals can submit applications and receive results directly at the headquarters of the Motor Vehicle Registration Unit, through the postal system, or through other appropriate forms.
