Regarding this matter, LawNet would like to answer as follows: 

The procedures for issuance of the license to practice medicine (hereinafter referred to as practicing license) during the transitional period in Vietnam are regulated in Decision 1388/QD-BQP in 2024 as follows:

1. Application for issuance of the license to practice medicine during the transitional period in Vietnam

The application for issuance of the practicing license for medical practitioners whose licenses have expired during the transitional period in accordance with the regulations in Article 10 of Decree 16/2024/ND-CP, includes:

- Application form for issuance of the practicing license according to Form No. 01 in Appendix II attached to Decree 16/2024/ND-CP.

- One of the following documents: Degree as specified in Article 43 of Decree 16/2024/ND-CP or a practicing license issued by a competent foreign authority recognized by the Ministry of Health.

- Confirmation of the practical training period according to Form No. 03 in Appendix I attached to Decree 16/2024/ND-CP, except for the following cases:

+ Practitioners who have completed a specialized training program and submitted an application for a new specialized license within 24 months from the date of receiving the specialized degree;

+ Cases specified in point b, clause 1, Article 23 of the Law on Medical Examination and Treatment in 2023.

- Curriculum vitae with certification from the head of the working unit from the battalion level and above.

- Two color passport-size photos, white background, size 04 cm x 06 cm, taken within 06 months prior to the application date.

- Original practicing license for cases where the practitioner has changed their professional title, as recorded on the practicing license as specified in point b, clause 1, Article 30 of the Law on Medical Examination and Treatment in 2023.

- Decision to revoke the practicing license for one of the cases specified in point a, point b, clause 1, Article 7 of Decree 16/2024/ND-CP.

2. Procedures for issuance of the license to practice medicine during the transitional period in Vietnam

- Step 1: The applicant for issuance of the practicing license shall submit one set of documents as prescribed in Article 45 of Decree 16/2024/ND-CP directly, via postal service, or electronically to the Medical Department/Office directly under the Ministry of National Defense.

- Step 2: In the case of valid documents, within 5 working days from the date of receiving the application, the coordinating unit under the Ministry of National Defense shall compile and send a list directly, via postal service, or electronically, to the competent health management authority, along with the application from the medical practitioner and the request letter from the head of the coordinating unit under the Ministry of National Defense.

In the case of invalid documents, within 3 working days from the date of receiving the application, the coordinating unit under the Ministry of National Defense or the competent health management authority must provide a written response to the submitting unit, specifying the specific reasons for the invalidity and requesting amendments to the required documents. The time for amending the documents shall not be counted towards the processing time.

- Step 3: Within 5 working days from the date of receiving the valid documents, the competent health management authority shall review the application, complete the procedures, and submit the authority to issue the practicing license. In case the practicing license is not issued, a written response must be provided, stating the reasons.

- Step 4: Within the period of 20 days from the date of receiving the submission from the competent health management authority, the issuing authority is responsible for issuing the decision to issue the practicing license and returning the practicing license to the practitioner.
