Below are the procedures for issuance of CFS for exported goods in Vietnam as specified in Decree 69/2018/ND-CP.

1. Procedures for issuance of CFS for exported goods in Vietnam

The procedure for issuing a Certificate of Free Sale (CFS) for exported goods in Vietnam according to Clause 3, Article 11 of Decree 69/2018/ND-CP is as follows:

* The trader submits 1 dossier directly or via postal service or online (if applicable) to the CFS issuing authority. The dossier includes:

- A request document for issuing CFS clearly stating the product name, HS code of the goods, product standard certification number or registration number, standard number (if any), component compound content (if any), importing country: 1 original, presented in Vietnamese and English.

- Investment certificate, business registration certificate, or enterprise registration certificate: 1 copy stamped by the trader.

- List of production facilities (if any), including the name, address of the facility, and items produced for export: 1 original.

- The standard declaration applied to the product, goods attached with its form (on product label or packaging or accompanying documents): 1 stamped copy by the trader.

* In case the dossier is incomplete, non-conformable, within 3 working days from the date of receipt, the CFS issuing authority notifies the trader to complete the dossier.

* The time limit for issuing CFS is no more than 3 working days from the date the trader submits a complete, conformable dossier. If the CFS is not issued, the CFS issuing authority provides a written response stating the reason.

* The CFS issuing authority may conduct on-site inspections at the production location if it deems that the dossier review is insufficient to issue the CFS or if there are signs of violations regarding previously issued CFS.

* The quantity of CFS issued for goods is according to the trader’s request.

* In case of supplementing, amending CFS; re-issuance due to loss, misplacement of CFS, the trader sends a request document and related papers to the CFS issuing authority. Within 3 working days from the date of receiving a complete, conformable dossier, the CFS issuing authority considers adjusting or re-issuing the CFS for the trader.

2. Regulations on the CFS for imported goods in Vietnam

Regulations on the Certificate of Free Sale (CFS) for imported goods in Vietnam according to Article 10 of Decree 69/2018/ND-CP are as follows:

- The list of goods and the authority to manage CFS are stipulated in Appendix V of Decree 69/2018/ND-CP.

- Based on management requirements in each period and within the scope of the Goods List stipulated in Clause 1, Article 10 of Decree 69/2018/ND-CP, ministries and equivalent agencies shall detail the list of imported goods subject to CFS submission along with the HS code of goods.

- The CFS must include at least the following information:

+ The name of the issuing authority or organization.

+ The number, issuance date of the CFS.

+ The name of the product or goods granted the CFS.

+ The type or group of products or goods granted the CFS.

+ The manufacturer’s name and address.

+ The CFS must clearly state that the products or goods are manufactured and permitted for free sale in the market of the country of production or the country issuing the CFS.

+ The full name, signature of the person signing the CFS, and the stamp of the issuing authority or organization.

- Ministries and equivalent agencies with competent management shall stipulate specific cases where a CFS applies to multiple shipments.

- At the request of the competent management ministry or agency, the CFS must be consularly legalized according to legal provisions, except where consular legalization is exempted under international treaties to which Vietnam is a member or on a reciprocal basis.

- In case of doubts about the authenticity of the CFS or the imported goods not matching the CFS content, the competent authority sends a request for verification to the issuing authority or organization.
