Regarding this issue, LawNet would like to answer as follows:

Procedures for granting and renewing the Certificate of eligibility for technical inspection of occupational safety are specified in Decision 1549/QD-LDTBXH 2023 as follows:

1. Procedures for issuance of Certificate of eligibility for technical inspection of occupational safety in Vietnam

1.1. Application for issuance of Certificate of eligibility for technical inspection of occupational safety

* Dossier to request issuance of Certificate of eligibility for technical inspection of occupational safety includes:

- Application for issuance of Certificate (01 copy);

- Copy of establishment decision for public service units (01 copy);

- List of equipment and tools for inspection (01 copy);

- List of inspectors (01 copy);

- One of the following documents to prove the experience of the person in charge of technical inspection activities:

+ Copy of book or separate sheet on social insurance participation (01 copy);

+ Copy of labor contract (01 copy);

+ Copy of inspection record accompanied by certificate of inspection results (01 copy of each type).

* Submission methods: Submit applications via an online public service portal, postal service, or in person.

1.2. Procedure for issuance of Certificate of eligibility for technical inspection of occupational safety

- Step 1: Receive application for the issuance of Certificate of eligibility for technical inspection of occupational safety

Organizations wishing to issue a Certificate shall send 01 set of application documents for a Certificate of eligibility for technical inspection of occupational safety to the Department of Labor Safety, Ministry of Labor, War Invalids, and Social Affairs.

- Step 2: Assess conditions

The receiving agency evaluates the conditions on the application file and evaluates it directly at the requesting organization.

- Step 3: Issue Certificate or refuse to issue

No more than 30 days from receipt of complete and valid documents, the Director of the Department of Labor Safety will sign the Minister's authorization for the Certificates of eligibility for inspection activities. In the event that the certificate is not issued, the Director of the Department of Labor Safety will sign, with the Minister's authorization, the refusal letter and clearly state the reason for not issuing the Certificate to the requesting organization.

2. Procedures for renewing the Certificate of eligibility for technical inspection of occupational safety in Vietnam

2.1. Application for renewal of Certificate of eligibility for technical inspection of occupational safety

* Dossier requesting an renewal of Certificate of eligibility for technical inspection of occupational safety includes:

- Application for renewal of Certificate (01 copy);

- Certificate has been issued (01 copy);

- Documents below in case of changes:

+ Copy of establishment decision for public service units (01 copy);

+ List of equipment and tools for inspection specified in Appendix Ia issued with Decree No. 44/2016/ND-CP dated May 15, 2016 of the Government (01 copy);

+ List of inspectors according to the form in Appendix Ia issued with Decree 140/2018/ND-CP dated October 8, 2018 of the Government (01 copy);

+ One of the following documents to prove the experience of the person in charge of technical inspection activities:

* Copy of book or separate sheet on social insurance participation (01 copy);

* Copy of labor contract (01 copy);

* Copy of inspection record attached to the certificate of inspection results (01 copy of each type).

* Submission methods: Submit application via an online public service portal, postal service, or in person.

2.2. Procedures for renewing the Certificate of eligibility for technical inspection of occupational safety

- Step 1: Receive application for an renewal of Certificate of eligibility for technical inspection of occupational safety

Organizations wishing to extend the Certificate shall send 01 set of dossier requesting renewal of the Certificate of eligibility for technical inspection of occupational safety to the Department of Labor Safety, Ministry of Labor, War Invalids and Social Affairs (at least 30 days before the expiration date of the Certificate)

- Step 2: Assess conditions

The receiving agency evaluates the renewal conditions on the dossier and evaluates it directly at the requesting organization.

- Step 3: Renew the Certificate or refuse to issue it

No more than 30 days from receipt of complete and valid documents, the Director of the Department of Labor Safety will sign the Minister's authorization for the Certificates of eligibility for inspection activities. In the event that the certificate is not issued, the Director of the Department of Labor Safety will sign, with the Minister's authorization, the refusal letter and clearly state the reason for not issuing the Certificate to the requesting organization.
