Regarding this issue, LawNet would like to answer as follows:

Procedures for granting the Certificate of eligibility for technical inspection of occupational safety are prescribed in Decision 1549/QD-LDTBXH 2023.

1. Application for issuance of Certificate of eligibility for technical inspection of occupational safety in Vietnam

* Documents:

- Application for inspector certificate (01 copy);

- Certified copy of the applicant's university diploma or present the original for comparison (01 copy);

- Documents proving the standards specified in Clause 3 and Clause 4, Article 9 of Decree 44/2016/ND-CP (01 copy of each type), specifically:

+ Documents proving at least 02 years of working as an inspection technician or working in design, production, installation, repair, operation, and maintenance of the subject of inspection;

+ Documents proving completion of the training course and satisfactory testing on technical inspection of occupational safety for the inspected subjects or have conducted inspection of inspected objects for more than 10 years by the time this Decree takes effect.

- 02 3x4 color photos of the person requesting the certificate taken within 6 months from the date of request.

* How to submit application:

Individuals wishing to issue an inspector certificate send 01 set of documents to the competent authority directly at the One-Stop Department, via postal service, or online at the National Public Service Portal or the Public Service Portal of the Ministry of Labor, War Invalids, and Social Affairs.

2. Procedure for issuance of Certificate of eligibility for technical inspection of occupational safety in Vietnam

- Step 1: Receive application for inspector certificate

Individuals who need an inspector certificate send 01 set of application documents for an inspector certificate to the Department of Labor Safety, Ministry of Labor, War Invalids and Social Affairs.

- Step 2: Evaluate the application for an inspector certificate

- Step 3: Issue the inspector's certificate or respond in writing clearly stating the reason for not issuing it

No more than 05 working days from the receipt of complete and valid documents, the Department of Labor Safety issues an inspector certificate or issues an official response clearly stating the reason for not issuing an inspector certificate to the applicant.

3. Standards of granting certificate of eligibility for technical inspection of occupational safety in Vietnam

Standards of granting certificate of eligibility for technical inspection of occupational safety specified in Article 9 of Decree 44/2016/ND-CP, specifically:

- Have university level or higher of engineering specialty in line with the inspected objects;

- Are fit for meeting job requirements;

- Have at least 02 years working as inspector or perform work of design, production, installation, repair, operation and maintenance of inspected objects;

- Have completed the training and testing course and successfully passed the requirements for inspection techniques of occupational safety to the inspected objects or have the time of carry out the inspection over the inspected objects more than 10 years by the time of effect of this Decree.

4. Management and use of Certificate of inspector in Vietnam

- The inspectors must present their Certificate of inspector as required by the state competent authorities and with organizations and individuals having the objects for inspection; only conduct the inspection to the inspected objects within the range specified on the Certificate of inspector.

- The Certificate of inspector shall be revoked in the following cases:

+ Forging or perjuring documents in dossier for issue and re-issue of Certificate of inspector.

+ Arbitrarily erase or modify the content of Certificate;

+ Not having worked for any inspecting organization for 12 months or more;

+ Conducting the inspection beyond the range specified in the Certificate of inspector;

+ Having conduction the inspection not in line with the inspection procedures.

- The body with issue authority is the body with authority to issue the decision on revocation of Certificate of inspector.
