Regarding this matter, LawNet would like to answer as follows: 

On April 11, 2024, the Chief Justice of the Supreme People's Court issued Circular 01/2024/TT-TAND on emulation and commendation of the People's Court in Vietnam.

Procedures for consideration for awarding emulation titles and forms of commendation of the People's Court in Vietnam 

According to Article 29 of Circular 01/2024/TT-TAND, the procedures for consideration for awarding emulation titles and forms of commendation of the People's Court in Vietnam are as follows:

- Cases proposed for awarding emulation titles and forms of commendation must submit a report on their achievements to be presented at the meeting to review the emulation and commendation of the small-scale collective or the district-level People's Court (for cases under the jurisdiction of the district-level People's Court). After reviewing and evaluating the achievements, voting is conducted to select individuals or collectives to be awarded emulation titles and forms of commendation in ascending order.

The head of the small-scale collective, the Chief Justice of the district-level People's Court, prepares an application for cases that meet the criteria and conditions for proposing emulation titles and forms of commendation to be submitted to the "Council for Emulation and Commendation at the grassroots level" or the "Emulation and Commendation Conference of the unit" (for units under the Supreme People's Court without separate seal and account) for consideration.

The "Emulation and Commendation Conference of the unit" consists of: the leadership of the unit; representatives of the party committee, trade union, youth union, and small-scale collective within the unit (if any); For units with leadership, the Chief Justices of the Supreme People's Court hold joint meetings to provide guidance.

For individuals and collectives considered for the titles of "Labor Hero," "National Emulation Fighter", "People's Court Emulation Fighter," the approval rate must be 90% or higher, calculated based on the total number of officials, public employees, and workers in the small-scale collective or the district-level People's Court; for the title of "Grassroots-level Emulation Fighter," the approval rate must be 80% or higher, calculated based on the total number of officials, public employees, and workers in the small-scale collective or the district-level People's Court (if there are absent individuals, opinions are obtained in writing and recorded in the minutes of the meeting to review emulation titles and forms of commendation).

- The "Council for Emulation and Commendation at the grassroots level" or the "Emulation and Commendation Conference of the unit" holds a meeting to consider the cases proposed for emulation titles and forms of commendation when at least 2/3 of the total members are present.

For individuals and collectives recommended for the titles of "Labor Hero," "National Emulation Soldier," "People's Court Emulation Soldier," the approval rate from the "Council for Emulation and Commendation at the grassroots level" or the "Emulation and Commendation Conference of the unit" must be 90% or higher, calculated based on the total number of members of the Council or Conference; for the titles of "Grassroots-level Emulation Fighter," "People's Court Emulation Flag," the approval rate from the "Council for Emulation and Commendation at the grassroots level" or the "Emulation and Commendation Conference of the unit" must be 80% or higher, calculated based on the total number of members of the Council or Conference (if there are absent members, opinions are obtained in writing and recorded in the minutes of the meeting to review emulation titles and forms of commendation).

- Based on the proposal of the "Council for Emulation and Commendation at the grassroots level" or the "Emulation and Commendation Conference of the unit," the head of the agency or unit makes a decision to award commendations or proposes the competent authority to consider awarding emulation titles and forms of commendation.

- The Council for Emulation and Commendation of the People's Court organizes a meeting to review cases proposed for emulation titles and forms of commendation within the jurisdiction of the Chief Justice of the Supreme People's Court. The meeting of the Council for Emulation and Commendation of the People's Court is held when at least 2/3 of the total members are present.

For individuals and collectives considered for the titles of "Labor Hero," "National Emulation Fighter," "People's Court Emulation Fighter," the approval rate from the Council for Emulation and Commendation of the People's Court must be 90% or higher, calculated based on the total number of members of the Council; for the titles of "Grassroots-level Emulation Fighter," "People's Court Emulation Flag," the approval rate from the Council for Emulation and Commendation of the People's Court must be 80% or higher, calculated based on the total number of members of the Council (if there are absent members, their opinions are obtained in writing and recorded in the minutes of the meeting to review emulation titles and forms of commendation).

- Based on the proposal of the Council for Emulation and Commendation of the People's Court, the Chief Justice of the Supreme People's Court decides to award commendations or proposes the competent authority to consider awarding emulation titles and forms of commendation.

- Each voting round for selecting cases proposed for commendation and titles of merit can only be conducted up to 2 times. If, after 2 rounds of voting, no selection is made, the consideration for awarding emulation titles and forms of commendation will be determined by the competent authority as stipulated in Article 26 of Circular 01/2024/TT-TAND or by the Head and Deputy Head of the emulation cluster (for Emulation Flags). In this case, individuals or collectives with outstanding achievements will be given priority for consideration and will be proposed for consideration for commendations.

- For individuals who are assigned or sent to another agency or unit for a certain period of time, the assigning or sending agency or unit assesses and recommends consideration based on the opinions and comments received from the receiving agency or unit.

- For individuals who are transferred to a new position, the new agency or unit is responsible for assessing and recommending consideration (in cases where the individual has worked at the previous agency or unit for more than 6 months, opinions and comments from the previous agency or unit are required).

More details can be found in Circular 01/2024/TT-TAND, which comes into force from June 11, 2024.

Circular 01/2024/TT-TAND replaces Circular 01/2018/TT-TANDTC and previous guidelines for emulation and commendation of the People's Court that are inconsistent with the provisions of Circular 01/2024/TT-TAND.
