Procedures for approving investment guidelines, issuing investment registration certificates, approving investors and adjusting golf course projects in Vietnam (Internet image) 

1. Procedures for approving investment guidelines, issuing investment registration certificates, approving investors and adjusting golf course projects in Vietnam

According to Article 10 of Decree 52/2020/ND-CP (amended by Clause 1 Article 107 of Decree 31/2021/ND-CP), the procedures for approving investment guidelines, issuing investment registration certificates, approving investors and adjusting golf course projects in Vietnam are stipulated as follows:

- The authority, dossier, processes, and procedures for approving investment policies, approving investors, issuing investment registration certificates, and adjusting investment projects on building and operating golf courses are carried out in accordance with the investment laws and Decree 52/2020/ND-CP.

- The investment project proposal for building and operating golf courses includes contents as prescribed by investment laws and Decree 52/2020/ND-CP, including content explaining the fulfillment of principles and conditions stipulated in Articles 3, 5, 6, 7, and 8 of Decree 52/2020/ND-CP.

- The content of appraisal for approving investment policies, and appraisal of the content of adjusting investment projects for building and operating golf courses are performed in accordance with investment laws and Decree 52/2020/ND-CP, including the evaluation of compliance with principles and conditions as stipulated in Articles 3, 5, 6, 7, and 8 of Decree 52/2020/ND-CP.

2. Guidance on Implementing Golf Course Projects in Vietnam

Specifically, Article 11 of Decree 52/2020/ND-CP provides guidance for implementing golf course projects as follows:

- Investors are only permitted to implement golf course projects after obtaining an investment policy decision or being granted an investment registration certificate (for projects required by law to complete the procedure for granting investment registration certificates); and completing procedures related to land, construction, and environmental impact assessment report approval according to the law.

- During the implementation of the golf course project, investors are responsible for carrying out policy reports, monitoring, and evaluating investment activities according to the investment laws.

- The transfer of a golf course project associated with land use rights transfer must meet conditions and procedures in accordance with investment laws, land laws, real estate business laws, and relevant laws.

- The conditions and procedures for adjusting, terminating golf course projects are implemented in accordance with investment laws, relevant laws, and Decree 52/2020/ND-CP.

3. Guidelines for supervision, assessment and inspection of execution of golf course projects in Vietnam

Pursuant to Article 12 of Decree 52/2020/ND-CP, the guidelines for supervision, assessment and inspection of execution of golf course projects are as follows:

- The provincial People's Committee, the Investment Registration Agency, and related agencies are responsible for executing policies, monitoring, and evaluating the implementation of golf course projects according to the investment laws and related laws.

- Inspection and auditing of golf course projects are conducted in accordance with the laws on auditing.
