Regarding this issue, LawNet would like to answer as follows:

April 3, 2023, the Minister of Labor, War Invalids, and Social Affairs of Vietnam issued Decision 406/QD-LDTBXH on the announcement of newly promulgated administrative procedures and abrogated administrative procedures within the scope of state management functions of the Ministry of Labor, War Invalids, and Social Affairs.

1. Procedures for annual recognition of households escaping poverty in Vietnam

1.1. Application for annual recognition of households escaping poverty on an annual basis

Application for annual recognition of households escaping from poverty and households escaping near poverty  is specified as follows:

Application for recognition of households escaping poverty and households escaping near poverty, made according to Form No. 04 in the Appendix issued together with Decision 24/2021/QD-TTg.

* How to do it: Apply in person, by postal service, or through the Online Public Service Portal.

1.2. Order of annual recognition of households escaping poverty

The order of recognition of households escaping poverty and households escaping near poverty regularly every year includes 5 steps as follows:

Step 1: The household has a written request for recognition of households escaping from poverty and households escaping from near poverty using Form No. 04 in the Appendix issued together with Decision 24/2021/QD-TTg to the People's Committee of the commune.

Step 2: The commune-level People's Committee chairperson directs the commune-level Review Steering Committee to assume the prime responsibility for, and coordinate with village heads and reviewers in, collecting household information, calculating scores, summarizing, and classifying households.

Step 3: Hold a meeting of the people to agree on the review results:

- Members of the meeting: Commune-level Review Steering Committee, civil servants tasked with poverty reduction at commune level, village head (chairing the meeting), village cell secretary, mass organization, reviewer, and a number of household representatives through the review, other households; invite representatives of the Vietnam Fatherland Front at commune level to supervise.

- Contents of the meeting: collecting the opinions of at least 50% of the total number of people attending the meeting on the evaluation results and scoring for the reviewed households.

If the consensus is less than 50%, review at Step 2 and hold a meeting at Step 3.

- The meeting results are made into 02 minutes, signed by the chairperson, secretary of the meeting, and representatives of households (01 copy is kept in the village, 01 copy is sent to the Steering Committee for review at commune level).

Step 4: Listing, public announcement

- Publicly post up the results of the review of households escaping from poverty and households escaping from near poverty at cultural houses or village community activity houses and offices of commune-level People's Committees;

Announcement via commune-level radio station (if any) within 03 working days.

- During the time of listing, make a public announcement:

In case of complaints from people, the Commune Review Steering Committee shall organize a review of the review results in accordance with the review process within 07 working days from the date of receipt of the complaint;

Publicly post the inspection results at the cultural house or village community house and the headquarters of the commune-level People's Committee within 3 working days.

- At the end of the time limit for public listing and review (if any), the Commune Review Steering Committee shall summarize and report to the Chairman of the Commune People's Committee on the list of households escaping poverty and households escaping near poverty (after review).

Step 5: Recognition of households escaping poverty and households escaping near poverty

Chairman of the commune-level People's Committee shall issue a decision on recognition of the list of households escaping poverty and households escaping from near poverty using Form No. 02 in the Appendix issued together with Decision 24/2021/QD-TTg.

In cases of ineligibility as prescribed, the chairperson of the commune-level People's Committee shall reply in writing and clearly state the reason.

2. Methods of reviewing and classifying poor and near-poverty households in Vietnam

Methods of reviewing poor and near-poverty households as prescribed in Clause 1, Article 2 of Decision 24/2021/QD-TTg are as follows:

- Survey to collect information from households, calculate and summarize scores according to Appendix III and Appendix IV issued together with Circular 07/2021/TT-BLDTBXH (amended by Circular 02/2022/TT-BLDTBXH), estimate income, and determine the level of lack of basic social services in poor and near-poverty households as follows:

+ Regarding the level of per capita income (referred to as point A):

In rural areas, 140 points is equivalent to an average income of 1,500,000 VND/person/month;

In urban areas, 175 points is equivalent to a per capita income of 2,000,000 VND/person/month.

+ About the degree of lack of basic social services (referred to as point B): 10 points is equivalent to 01 index measuring the level of the basic social service shortage.

- Classification of poor households, near-poverty households

+ Poor households: households with A 140 points and B 30 points in rural areas or A ≤ 175 points and B points ≥ 30 points in urban areas;

+ near-poverty households: households with A ≤ 140 points and B < 30 points in rural areas or A ≤ 175 points and B points < 30 points in urban areas.
