1. Procedures and documentation for Application for Certification of Science and Technology Enterprise in Vietnam

The procedures and dossier for requesting certification of science and technology enterprises as per Article 7 of Decree 13/2019/ND-CP are as follows:

- Enterprises that meet the conditions specified in Article 6 of Decree 13/2019/ND-CP shall submit one dossier requesting certification of a science and technology enterprise to the competent authority as regulated in Article 5 of Decree 13/2019/ND-CP. The dossier can be submitted directly, via postal service, or online.

- A dossier requesting certification of a science and technology enterprise includes:

+ Request for certification of a science and technology enterprise according to Form No. 01 in the Appendix issued with Decree 13/2019/ND-CP;

+ Documents certifying or recognizing scientific and technological results from the competent authority (a copy presented with the original for comparison or a certified copy), belonging to one of the following documents:

++  Intellectual  property  rights  protection  certificate;

++  Decision  to  recognize  new  plant  varieties,  new  animal  breeds,  new  aquatic  breeds,  new  forestry  plant  breeds,  technical  advances;

++  Award  certificates  for  results  that  have  won  awards  in  science  and  technology  granted  by  the  competent  governmental  authority  or  in  coordination  with  organizing  the  award  or  consenting  to  organize  the  awards;

++  Decision  to  recognize  results  of  scientific  and  technological  tasks  using  the  state  budget  or  Certificate  of  registration  of  results  of  scientific  and  technological  tasks  using  the  state  budget;  Confirmation  or  evaluation  certificate  of  results  of  scientific  and  technological  tasks  not  using  the  state  budget;

++  Certificate  of  technology  transfer  registration;++  Other  documents  certifying  or  recognizing  with  equivalent  legal  value.

+ Business plan for producing and trading products formed from scientific and technological results according to Form No. 02 in the Appendix issued with Decree 13/2019/ND-CP.

2. Assessment of dossier and granting Certificate of Science and Technology Enterprises in Vietnam

Dossier assessment and granting certificate of science and technology enterprises as per Article 8 of Decree 13/2019/ND-CP are as follows:

- Within 3 working days from the date of receiving the dossier requesting certification of a science and technology enterprise, the competent authority must respond to the enterprise regarding the dossier's validity, specifying the documents, contents that need modification, supplementation, and the timeline for making these changes if the dossier is not valid.

- Within 10 working days from the date of receiving a valid dossier, the competent authority is responsible for considering issuing or refusing to issue the certificate of a science and technology enterprise. The certificate is issued according to Form No. 03 in the Appendix issued with Decree 13/2019/ND-CP.

In cases where scientific and technological results involve multiple complex sectors or fields requiring expert consultation or the establishment of a consultancy council for appraisal and evaluation, the duration for granting the certificate shall not exceed 15 working days from the date of receiving a valid dossier.

- In the case specified in point c, clause 2, Article 5 of Decree 13/2019/ND-CP, after receiving a complete valid dossier, within 5 working days, the Department of Science and Technology is responsible for forwarding the entire dossier requesting certification of the enterprise to the Department of Market Development and Science and Technology Enterprises for granting the certificate.

- Within 5 working days from the date of issuing the certificate, the issuing authority must publish on its electronic portal the name, address, and list of products formed from the scientific and technological results of the said enterprise.
