1. Procedure for extracting information on the identification database in Vietnam

The procedure for extracting information from the identification database in Vietnam according to Article 18 Decree 70/2024/ND-CP is as follows:

- Extraction by written request for information:

+ Agencies, organizations, and individuals with a written request for extracting information from the identification database must send it to the citizen management authority of the District or Provincial Police where the citizen resides;

+ The written request for providing information must clearly state the purpose, content, scope of the information to be extracted from the identification database and guarantee responsibility for the use of information when extracted; for cases of extracting information under point d, clause 1, Article 17 Decree 70/2024/ND-CP, it must clearly indicate the agreement of the subject whose information is to be extracted;

+ Within one working day, the citizen management authority of the District or Provincial Police forwards the request for providing information from the identification database to the head of the citizen management authority of the Ministry of Public Security;

+ Within one working day, the head of the citizen management authority of the Ministry of Public Security reviews and approves the request for permission to extract information;

+ Within one working day from the date the head of the citizen management authority of the Ministry of Public Security approves, the citizen management authority of the District or Provincial Police provides information from the identification database to the requesting agency, organization, or individual;

+ If the request for providing information is not approved, there must be a written response stating the reasons.

- Citizens who have been issued electronic identification cards log into the National Identification Application to send a request to extract their information from the identification database.

- The extraction of information from the identification database through the electronic identification and authentication platform is carried out according to the provisions of the law on electronic identification and authentication.

- For the cases where the legal representative of a person who has lost civil act capacity, a person with cognitive and behavioral difficulties, a person under 14 years old, a person declared missing, or the heir of a deceased person extracts information from the identification database, a written request for providing information and documents proving that they are the legal representative or heir of the citizen is required, except where the information proving the representative or heir is already in the National Population Database or other national databases and specialized databases.

2. Regulations on connecting and sharing information on the identification database in Vietnam

The regulations on connecting and sharing information on the identification database in Vietnam according to Article 16 Decree 70/2024/ND-CP are as follows:

- National databases, specialized databases, information systems of state agencies, political organizations, and socio-political organizations are connected and share information with the identification database through telecommunications networks, computer networks, and dedicated networks to serve state management tasks according to assigned functions, duties, and powers.

- Agencies and organizations not specified in clause 1, Article 16 Decree 70/2024/ND-CP can connect with the identification database through the electronic identification and authentication platform to serve electronic authentication activities, digital economy development, digital society, and digital citizens.

- The connection and sharing of information between the identification database and other information systems shall be carried out on the basis of written agreement between the Ministry of Public Security (Hanoi, Vietnam) and the managing agency of the information system to ensure information security, safety, and personal data protection when connecting and sharing information with the identification database. The information systems of state agencies must meet the following requirements:

+ Complying with IT technical standards and regulations in connection and sharing with the identification database;

+ Ensuring a minimum security level 3 according to legal provisions on ensuring the security level of information systems when officially connected.

- The citizen management authority of the Ministry of Public Security is responsible for notifying in writing the rejection or temporary suspension of the connection and sharing of information with the identification database in the following cases:

+ The information system of the requesting agency does not meet the conditions stipulated in clause 3, Article 16 Decree 70/2024/ND-CP;

+ The connected agency engages in unauthorized access, altering, deleting, destroying, or disseminating information in the identification database;

+ The connected agency violates regulations on personal data protection or the agreed-upon content with the Ministry of Public Security (Hanoi, Vietnam) as stipulated in clause 3, Article 16 Decree 70/2024/ND-CP.
