Procedure for approving the annual number of people working in the public service units in Vietnam

The order for approving the annual number of people working in public service units is implemented according to the provisions of Article 9 of Decree 106/2020/ND-CP as follows:

- Public service units self-guarantee regular expenditures and investment expenditures, and public service units self-fund regular expenditures based on Clause 2, Article 4 of Decree 106/2020/ND-CP and guiding documents from competent authorities on the number of people working in public service units by industry and field to plan the annual number of people working; organize an appraisal and submit it to the head of the public service unit for approval.

In case a public service unit has a Management Council, the head of the unit must submit it to the Management Council for approval before deciding whether to approve the number of people working in the unit.

- Public service units themselves cover part of their regular expenses, and public service units have their regular expenditures covered by the state budget:

+ Pursuant to Clause 2, Article 4 of Decree 106/2020/ND-CP and guiding documents of competent authorities on the number of people working in public service units according to industry and field, public service units plan the number of people working and receive salaries from their unit's annual state budget and report to the direct superior management agency to report to agencies and organizations specified in Point b, Clause 2, Article 9 of Decree 106/2020/ND-CP.

For public service units that cover part of their regular expenses, the plan for the number of employees includes: Number of people working and receiving salary from the state budget and number of people working and receiving salary from non-business revenue sources.

+ Agencies and organizations assigned the task of organizing staff of ministries, branches, and localities receive applications and organize appraisals of the number of workers for public service units; summarize the number of people working in public service units that cover part of their regular expenses and public service units with regular expenditures guaranteed by the state budget of ministries, branches, and localities; and submit them to the heads of ministries, branches, and localities to send to the Ministry of Home Affairs for appraisal.

+ The Ministry of Home Affairs appraises the plan for the number of people working and receiving salaries from the state budget in public service units that cover part of their regular expenses and public service units with regular expenditure guaranteed by the state budget of ministries, branches, and localities.

+ Ministers, Heads of ministerial-level agencies, Heads of Government agencies, heads of organizations established by the Government or Prime Minister that are not public service units, the Director of Hanoi National University and the Director of Ho Chi Minh City National University decided to assign the number of people working and receiving salaries from the state budget for each public service unit, it self-guarantees part of its regular expenses, and for public service units, its regular expenditure is guaranteed by the state budget within the scope of management in the total number of employees assessed by the Ministry of Home Affairs; decide to assign the number of people working to receive salaries from non-business revenue sources for public service units that self-guarantee part of their regular expenses within the scope of management.

+ The Provincial People's Committee submits to the People's Council at the same level for approval the number of people working and receiving salaries from the state budget in public service units that cover part of their regular expenses and public service units due to the state budget ensuring regular expenditures within the scope of management within the total number of working people assessed by the Ministry of Home Affairs; decide to assign the number of people working and receiving salaries from the state budget to each public service unit under its management within the total number of people working approved by the People's Council; decide to assign the number of people working to receive salaries from non-business revenue sources for public service units that self-guarantee part of their regular expenses within the scope of management.

Amendments to the annual number of people working in the public service units in Vietnam

Pursuant to Article 10 of Decree 106/2020/ND-CP, the adjustment of the number of people working in public service units in Vietnam is carried out in the following cases:

- The public service unit has changed one of the grounds specified in Clause 2, Article 4 of Decree 106/2020/ND-CP;

- Public service units are established and reorganized according to the decisions of competent authorities.

The order and documents to adjust the number of employees comply with the provisions of Article 9 and Article 10 of Decree 106/2020/ND-CP.
