Regarding this issue, LawNet would like to answer as follows:

1. Priority in considering salary increases ahead of time for talented people who are officials (proposal) in Vietnam

Article 14 of the Draft Decree stipulates policies to attract and utilize talented people in state administrative agencies and public service units, clearly stating policies to utilize talented people as officials, public employees, and workers. In particular, the salary and welfare policies are clearly stated as follows:

- Priority in consideration for salary increase ahead of schedule (if any) or consideration for promotion of civil servant rank; consideration for promotion of civil servant's professional title without requirements on time holding rank or title class if there are particularly excellent achievements in public service activities, professional activities, or are classified as having excellently completed tasks for 03 consecutive years from the date of recruitment decision;

In addition, the policy of appreciating talented people as officials, civil servants, and public employees in salary and welfare policies also includes:

- Every month, talented people receive an incentive amount equal to 100% of their current salary. The incentive amount is not used to calculate social insurance and health insurance benefits. The incentive amount is determined in the regular expenditure estimate and allocated to agencies, organizations, units, and localities according to the provisions of the Law on State Budget;

- Priority is given to renting official housing or borrowing money to buy housing in installments under the guarantee of agencies and organizations from the Bank for Social Policies with preferential interest rates according to Government regulations;

- Maintain the same regime and policies while being sent for training and retraining. In case the study location is not in the locality of the work place, you will enjoy the same benefits as those who are sent on business trips;

- When transferred or seconded by a competent authority to take on tasks in difficult areas, they will receive support with housing and living conditions to stabilize work and continue to enjoy benefits and policies for cadres, civil servants, public employees, and talented workers; At the end of the rotation or secondment period, if the task is completed, agencies with authority to manage cadres, civil servants, and public employees are responsible for returning employees to their previous positions or assigning them to other, higher positions in accordance with their talents and professional expertise;

- When reaching retirement age, if you are healthy enough to voluntarily continue to work and the agency or unit has a need, the head of the agency managing cadres, civil servants, and public employees will consider and decide to extend the working time and retain the position and title of officials, civil servants, and public employees currently holding, but not for more than 05 years.

2. The system favors talented people as the target of attraction in Vietnam

- Recruitment through admission of excellent graduates and talented young scientists according to the Government's regulations on policies to attract and create staff from excellent graduates and young scientists

- Priority is given to signing professional contracts in public service units.

Regarding the salary policy, the welfare regime clearly states that every month, talented people will receive an incentive amount equal to 100% of their current salary.

The higher level of incentive money is decided by the agency's managing cadres, civil servants, public employees, and workers in accordance with the actual conditions of the agency or organization.

The incentive amount is not used to calculate social insurance and health insurance benefits. The incentive amount is considered and decided by the head of the agency employing talented people and is determined in the regular expenditure estimate and allocated to agencies, organizations, units, and localities according to the provisions of the Law on State Budget.
