Pursuant to Article 4 of Circular 143/2023/TT-BQP, disciplinary action in the Vietnam People's Army is carried out according to the following principles:

- Any disciplinary violations, when discovered, must be promptly prevented and strictly handled; Consequences caused by disciplinary violations must be overcome in accordance with the provisions of the law.

- Each disciplinary violation will only be handled once by one form of discipline; at the same time, considering disciplinary action, if the person violates 02 or more violations, he/she must consider and conclude each violation and make a general decision with the highest form corresponding to the violation. In the case of handling multiple forms of discipline, it will be decided by the competent authority.

- Disciplinary action must ensure objectivity, fairness, strictness, accuracy, and timeliness; correct authority, order, and procedures; in accordance with the provisions of law; synchronization between Army discipline and Party discipline; Military discipline is not lower than Party discipline; military discipline does not replace Party discipline or union discipline; and vice versa.

- Handling of disciplinary violations must be based on the content, motive, nature, extent, consequences, cause of violation, specific circumstances, mitigating circumstances, aggravating circumstances, attitude of accepting correction, overcoming defects, and the consequences of violations caused.

- Strictly prohibit all acts of violating the body, honor, dignity, and reputation of the violator during the process of considering disciplinary action; do not apply other forms of discipline instead of the form of discipline prescribed in this Circular.

- Do not take collective disciplinary action against agencies and units that violate the Party's guidelines and policies, the State's legal policies, or have many people violating discipline; Only consider disciplinary action that belongs to the responsibility of the commander, political commissar (hereinafter referred to as commander), and each individual violator.

- Do not apply the disciplinary form of demotion to military rank for officers and professional soldiers holding the rank of second lieutenant and soldiers holding the rank of private; Do not apply disciplinary measures of demotion or dismissal to violators who do not hold command or management positions; Do not apply the disciplinary form of salary reduction to officers whose salaries have not been raised; people working in cipher organizations; Officials, workers, and defense officials are receiving Level 1 salaries.

- When disciplinary action is taken, in addition to disciplinary action for each violation, if the violation causes material damage, the violator must also compensate. Property, money, and materials acquired due to violations must be handled in accordance with the provisions of the law.

- Commanders at all levels must be responsible for violations of discipline and law by their military personnel; Depending on the nature and extent of the violation, the consequences of the incident, and the degree of relevance to the responsibilities of the direct commander and a level above, disciplinary action shall be determined according to the provisions of this Circular.

- Do not transfer jobs to people found to have committed violations that have not been handled according to regulations. If a person commits a disciplinary violation that shows signs of a crime, the agency or unit will not reduce the number of management troops but will transfer the violation file to the investigation agency in the Army for handling according to the provisions of the law; In the case of being tried by a court and sentenced to non-custodial reform or imprisonment but given a suspended sentence, only the regime and policy will be resolved.
after the court's judgment or decision takes legal effect and the corresponding disciplinary action has been taken according to regulations.
