The Central Committee promulgates Regulation 80/QD-TW in 2022 on the decentralization of cadre management and the appointment and nomination of candidate cadres. Whereby:
According to Article 16 of Regulation 80/QD-TW, principles for appointing and nominating candidates include:
- Party committees, party organizations, and collective leaders of agencies and units consider and decide to appoint and nominate candidates according to their competence; ensuring the leadership of the Party, the principle of democratic centralism, objectivity, publicity, and transparency, and giving full play to the powers and responsibilities of each member and the head.
- Based on officials' standards, conditions, qualities, ethics, capacity, forte, and reputation, as well as the requirements of performing political tasks for localities, agencies, and units.
- Ensuring staff stability, succession, and ongoing development; improving work quality and efficiency.
- Failing to appoint, introduce candidates, mobilize, confer, or promote cadres and party members being investigated and disciplined.
Pursuant to Article 18 of Regulation 80/QD-TW, the criteria and conditions for the appointment and nomination of cadres for higher positions are regulated as follows:
- Ensuring general and specific title standards, as well as nominating candidates in accordance with regulations.
- Officers appointed from on-site human resources must be planned for an appointed title or an equivalent or higher title.For personnel from outside sources, they must be planned with equivalent titles or more. Special cases shall be considered and decided by competent authorities.
- Having held the current or a comparable position for at least two years.Special cases shall be considered and decided by competent authorities.
The appointment of officers in the armed forces shall be specified by the Central Military Commission and the Central Public Security Party Committee in accordance with practical requirements.
- Having a complete and clear profile, personal background, declaration of assets and income, and being appraised and verified by a competent authority.
- Age: Officers of agencies in the political system who are proposed to be appointed to a leadership or management position (higher) for the first time must be old enough to work for a full term. Special cases shall be considered and decided by competent authorities.
- Having enough health to complete assigned tasks.
- Disciplinary officers are not permitted to assign, appoint, or recommend candidates for positions higher than the one for which they are being disciplined for the following period of time (beginning with the date of signing the disciplinary decision):
+ 12 months for discipline Reprimand.
+ 30 months for disciplinary form Warning.
+ 60 months for discipline Dismissal.
The term of office holding of officials is specified in Article 19 of Regulation 80/QD-TW, specifically:
- The term of appointment to hold positions is 5 years (60 months) for leading and managerial cadres in agencies and units in the political system and state-owned enterprises.
- According to separate regulations, the term of appointment to hold a position for less than five years applies to a number of specific positions.
- The term of holding an elected office is determined by the organization.
