Principles for organizing conferences of cadres, civil servants, and public employees according to Article 2 of Circular 01/2016/TT-BNV are as follows:
- Conferences of cadres, civil servants, and public employees (hereinafter referred to as conferences) are a form of direct democracy for officials, civil servants, and public employees to participate in managing and building clean and strong agencies and units.
- The conference was organized democratically and practically, ensuring the contents specified in Article 5 of Decree 04/2015/ND-CP.
- A conference is validly held when at least 2/3 of the officials, civil servants, and public employees of the agency or unit, or at least 2/3 of the summoned delegates, are present to attend the conference. Resolutions and decisions of the conference are passed when more than 50% of the conference attendees agree and the content does not contravene the provisions of law.
The form of conference for cadres, civil servants, and public employees according to Article 3 of Circular 01/2016/TT-BNV is as follows:
- Regular conference: Held once a year at the end of the year.
For educational and training institutions, conferences can be held at the end of the school year to suit the industry's characteristics.
- Extraordinary conference: Organized when 1/3 of the officers, civil servants, and public employees of the agency or unit or the Executive Committee of the agency or unit's Trade Union request, or the head of the agency or unit finds it necessary.
According to Article 5 of Circular 01/2016/TT-BNV the ex-officio delegates and electing delegates to attend conferences of cadres, civil servants, and public employees are as follows:
- Delegates are of course representatives of the conference organizing level, including: Head, deputy of the head, Secretary of the Party Committee, President of the Trade Union, Head of the People's Inspection Committee, Chairman of the Veterans Association (if any), Secretary of the Ho Chi Minh Communist Youth Union (if any), Head of the Women's Union or officer in charge of the Women's Union.
- The election of delegates to attend the conference is conducted at the conference of units under the agency or unit through voting or a secret ballot decided by the conference by majority. The elected person must be elected by more than 50% of the total number of people attending the conference and selected on the principle of high to low until a sufficient number of delegates are allocated.
- The head of the agency or unit coordinates with the agency or unit's trade union to agree and decide on the number of delegates attending the conference to ensure the minimum number, as follows:
+ Agencies and units have a total number of officials, civil servants, and public employees ranging from over 200 to 300 people, or have 200 people or less but work dispersed over a large area, or for professional reasons cannot leave their working positions: Elect at least 1/3 of the officers, civil servants, and public employees of the agency or unit as delegates to attend the conference.
+ Agencies and units with a total number of officers, civil servants, and public employees of over 300 people: in addition to the minimum number of delegates required to be elected at Point a, Clause 3, Article 5 of Circular 01/2016/TT-BNV, for every 10 people, at least 1 additional delegate can be elected (from the 301st person onwards).
4. Instructions for organizing conferences of cadres, civil servants, and public employees
Instructions for organizing conferences of cadres, civil servants, and public employees according to Article 7 of Circular 01/2016/TT-BNV are as follows:
- Presidium and conference secretary:
+ The Presidium includes the head of the agency or unit and the President of the agency or unit's union. Depending on the nature and necessary requirements, the Presidium has a Secretary of the Party Committee of the agency or unit.
In case the head of an agency or unit or the President of an agency or unit's union is in the process of being disciplined in the form of a reprimand or higher, the collective leadership of an agency or unit or the Standing Committee of the agency or unit's trade union (or the Union Executive Committee if there is no Trade Union Standing Committee) appoints a representative to join the Presidium.
+ The conference secretary is appointed by the Presidium and performs tasks assigned by the Presidium.
- Conference content:
+ Heads of agencies, units, and presidents of agency and unit trade unions present documents and reports as assigned at Points b, c, d, Clause 1, Article 6 of Circular 01/2016/TT-BNV.
+ Officials, civil servants, and public employees attend conferences to discuss documents and reports, suggestions, and recommendations (if any).
+ The head and president of the trade union answer questions and make recommendations to officials, civil servants, and public employees for matters within their authority, discuss measures to improve working conditions, and improve the lives of officials, civil servants, and public employees in agencies and units.
+ The Head of the People's Inspection Committee presents a report on the People's Inspection Committee's activities during the year and the work program for the following year.
+ New election or consolidation of the People's Inspection Board (if any).
+ Approving internal spending regulations of agencies and units (if any).
+ Organizing rewards for individuals and groups of agencies and units with achievements in work; launching an emulation movement.
+ Signing an emulation contract between the heads of agencies and units and the trade union organization.
+ Passing the conference resolution.
- Funds for organizing conferences are allocated from the regular operating funds of agencies and units.
