1. Principles for determining job positions and workforce numbers in public service providers in Vietnam

The principles for determining job positions and workforce numbers in public service providers in Vietnam, according to Article 3 of Decree 106/2020/ND-CPP, are as follows:

- Implementing strictly the Party's guidelines and the law on job positions, workforce numbers, and streamlining organization in public service providers.

- Aligning with the functions, tasks, powers, and organizational structure of public service providers.

- Ensuring scientific, objective, transparent, and effective workforce planning, as well as improving the quality of public employees and workers in public service providers.

- Ensuring that each worker is assigned a sufficient workload to be completed within the prescribed working hours. Job positions that do not have enough workload to be completed within the prescribed working hours of one worker should be arranged as part-time positions.

- Ensuring a reasonable structure where the number of workers in job positions with professional titles and professional occupations accounts for at least 65% of the total workforce in public service providers.

2. Principles for determining job positions, workforce numbers, and professional title-occupation structure in Vietnam

The principles for determining job positions, workforce numbers, and professional title-occupation structure, according to Article 4 of Decree 106/2020/ND-CP, are as follows:

* Determining job positions based on:

  - The functions, tasks, powers, and organizational structure of public service providers.
  
  - The complexity, nature, characteristics, and scale of activities; the scope and target audience of services provided; and the management processes and professional requirements specified by the relevant laws and regulations.

- Determining workforce numbers based on:

  - The actual workload and tasks assigned to each job position in public service providers.
  
  - The level of modernization of office facilities, equipment, and work tools, and the application of information technology.
  
  - The current management and utilization of the assigned workforce in the organization.

- Determining the professional title-occupation structure based on:

  - The list of job positions.
  
  - The complexity of the tasks performed in each job position.
  
  - The corresponding professional title-occupation standards for each job position.

3. Approval process for job positions in public service providers in Vietnam

The approval process for job positions in public service providers in Vietnam, according to Article 6 of Decree 106/2020/ND-CP, is as follows:

- Public service providers self-fund regular and investment expenditures.

Based on Clause 1 of Article 4 of Decree 106/2020/ND-CP, public service providers develop a plan for job positions, organize the appraisal process, and submit it to the head of the public service provider for approval. The head of the public service provider then approves the job positions and professional title-occupation structure after they have been approved by the management board.

- Public service providers self-fund regular expenditures.

Based on Clause 1 of Article 4 of Decree 106/2020/ND-CP, and the guidance of the competent authority on job positions and professional title-occupation structure by sector and field, public service providers develop a plan for job positions, organize the appraisal process, and the head of the public service provider approves the job positions and professional title-occupation structure. In the case of public service providers with a management board, the head of the public service provider must first submit it to the management board for approval.

- Public service providers partially self-fund regular expenditures, and public service providers funded by the state budget.

Based on Clause 1 of Article 4 of Decree 106/2020/ND-CP and the guidance of the competent authority on job positions and professional title-occupation structure by sector and field, public service providers develop a plan for job positions and report to the direct management agency for direct management and submission to the authorized agency or organization for appraisal, as stipulated in point b, clause 3, Article 6 of Decree 106/2020/ND-CP.

The agencies and organizations responsible for organizing personnel of ministries, agencies at the same level as ministries, agencies under the Government, organizations established by the Government or the Prime Minister, National University of Hanoi, National University of Ho Chi Minh City, provincial and municipal People's Committees (referred to as ministries, agencies, localities), or agencies and organizations delegated with the task of organizing personnel by the delegated, authorized, and managed positions, receive and organize the appraisal of the plan for job positions of public service providers and submit it to the authorized agency according to the regulations stipulated in point c, clause 3, Article 6 of Decree 106/2020/ND-CP for approval.

The Minister, the head of the agency at the same level as the ministry, the head of the agency under the Government, the head of the organization established by the Government or the Prime Minister, the Director of the National University of Hanoi, the Director of the National University of Ho Chi Minh City, the provincial and municipal People's Committees (referred to as provincial People's Committees), or the agencies and organizations delegated with the task of organizing personnel according to the regulations, approve the job positions and professional title-occupation structure of public service providers within their management scope.

- The university council of public universities issues a list of job positions for the institution according to the provisions of the Law on Higher Education 2012 and Decree 106/2020/ND-CP.
