On September 11, 2024, the Government of Vietnam promulgated Decree 112/2024/ND-CP providing guidance on rice cultivation land in Vietnam.
Rice cultivation land is land used for growing at least one rice crop or rice combined with other legal land uses, but primarily for growing rice. Rice cultivation land includes specialized rice cultivation land and remaining rice cultivation land.
- Specialized rice cultivation land is land used for growing at least two rice crops per year;
- Remaining rice cultivation land is land used for growing one rice crop per year and upland rice cultivation land.

crop and livestock structure shift occurring on rice cultivation land involves changing from growing rice to growing annual crops; from growing rice to growing perennial crops; combining rice cultivation with aquaculture.
According to Clause 1, Article 6 of Decree 112/2024/ND-CP, the structure shift of the structure of crops and livestock on rice cultivation land must adhere to the following principles:
- Comply with the provisions of Clause 1, Article 56 of the Law on Crop Production 2018, specifically:
+ Align with the local land use planning, market demand, water resources, and climate conditions;
+ Form production areas focused on specific crops associated with land consolidation, exchange, and chain production linkage;
+ Ensure effective exploitation of existing infrastructure; comply with the planning and orientation for completing infrastructure to serve local agricultural production;
+ Maintain essential conditions for reverting to rice cultivation.
- Only convert the structure of crops and livestock on rice cultivation land to perennial crops on remaining rice cultivation land;
- Not convert the structure of crops and livestock on rice cultivation land in areas planned for high-yield, high-quality rice;
- Align with the structure shift plan for the structure of crops and livestock on rice cultivation land issued by the competent authority;
- Avoid causing pollution, degradation of rice cultivation land; prevent damage to transportation, irrigation, dike structures, and facilities directly serving rice production;
- Not affect the cultivation of adjacent rice cultivation land areas.
Article 8 of Decree 112/2024/ND-CP stipulates the applications and procedures for crop and livestock structure shift occurring on rice cultivation land in Vietnam as follows:
- Users of rice cultivation land who wish to convert to perennial crops, or combine rice cultivation with aquaculture, should submit a Registration Form for crop and livestock structure shift occurring on rice cultivation land (hereinafter referred to as the Registration Form) to the Commune People's Committee, according to Appendix IV issued with Decree 112/2024/ND-CP.
- Within 05 working days from the date of receiving a valid Registration Form for crop and livestock structure shift occurring on rice cultivation land, the Commune People's Committee will review the compatibility of the Registration Form with the annual structure shift plan for the structure of crops and livestock on rice cultivation land at the commune level.
+ If the Registration Form aligns with the annual structure shift plan for the structure of crops and livestock on rice cultivation land at the commune level, the Commune People's Committee issues a written approval allowing the structure shift according to the form in Appendix V issued with Decree 112/2024/ND-CP and sends it to the registrant;
+ If the Registration Form does not align with the annual structure shift plan for the structure of crops and livestock on rice cultivation land at the commune level, the Commune People's Committee issues a written notification according to the form in Appendix VI issued with Decree 112/2024/ND-CP and sends it to the registrant.
