Regarding this issue, LawNet would like to answer as follows:

Policies for teachers who concurrently work for Unions and Associations in Vietnam

According to Article 2 of Decision 13/2013/QD-TTg stipulating regimes and policies for teachers concurrently working in Unions and Associations as follows:

(i) Regarding time spent working on Union and Association work

- For universities:

+ The Secretary of the Union, the Secretary of the Youth Union's Personnel Committee who are lecturers is entitled to spend 70% of the time according to the standard teaching hours doing the work of the Union and the Association. Those who are not lecturers but concurrently the Secretary of the Union, the Secretary of the Youth Union's Personnel Committee are entitled to spend 70% of their working time on the work of the Union and Association;

+ The Deputy Secretary of the Youth Union, Deputy Secretary of the Youth Union's Personnel Committee, and the President of the Student Union as lecturers are entitled to spend 60% of the time according to the standard teaching hours to do the work of the Union and the Association. The Deputy Secretary of the Youth Union and the Deputy Secretary of the Youth Union's Human Resources Committee who are not lecturers, are entitled to spend 60% of their working time on Union and Association activities;

+ The Vice President of the Student Union who is a lecturer, is entitled to spend 50% of the time according to the standard teaching hours doing union and Association work. Those who are not lecturers but concurrently the Vice President of the Student Union are entitled to spend 50% of their working time doing Union and Association work.

- For member schools and faculties of universities; academies, universities, colleges, vocational colleges, professional intermediate schools, vocational intermediate schools, pre-university schools (hereinafter referred to as schools) with 10,000 students or more:

+ The Secretary of the Youth Union or the School-level Youth Assistant who is a lecturer is entitled to spend 70% of the time according to the standard teaching hours doing the work of the Union or the Association. Those who are not lecturers or teachers who are concurrently Secretary of the Youth Union or Assistant to the Youth at the school level are entitled to spend 70% of their working time on Union and Association activities;

+ The Deputy Secretary of the Youth Union, the President of the Student Union, the President of the Youth Union at the school level are lecturers, and teachers are entitled to spend 60% of their time according to the standard teaching hours to do the work of the Union and the Association. Those who are not lecturers and teachers but concurrently serve as Deputy Secretary of the Youth Union, President of the Student Union, President of the School-level Youth Union, are entitled to spend 60% of their working time on Union and Association activities;

+ Vice President of Student Union, Vice President of Youth Union at school level who are lecturers, teachers are entitled to spend 50% of the time according to standard teaching hours to do Union and Association work. Those who are not lecturers or teachers but also hold the position of Vice President of the Student Association or Vice President of the school-level Youth Union are allowed to spend 50% of their working time doing Union and Association work.

- For schools with from 5,000 to less than 10,000 students:

+ The Secretary of the Youth Union or the School-level Youth Assistant who is a lecturer is entitled to spend 60% of the time according to the standard teaching hours doing the work of the Union or the Association. Those who are not lecturers or teachers who are concurrently Secretary of the Youth Union or Assistant to the Youth at the school level are entitled to spend 60% of their working time on Union and Association activities;

+ The Deputy Secretary of the Youth Union, the President of the Student Union, the President of the Youth Union at the school level are lecturers, and teachers are entitled to spend 50% of their time according to the standard teaching hours to do the work of the Union and the Association. Those who are not lecturers or teachers but also hold the positions of Deputy Secretary of the Youth Union, President of the Student Union, or President of the school-level Youth Union are allowed to spend 50% of their working time doing Union and Association work;

+ Vice President of the Student Association, Vice President of the school-level Youth Union who are lecturers and teachers are allowed to spend 40% of their time according to standard teaching hours doing union and Association work. Those who are not lecturers or teachers but also hold the position of Vice President of the Student Association or Vice President of the school-level Youth Union are allowed to spend 40% of their working time doing Union and Association work.

- For schools with less than 5,000 students:

+ Youth Union Secretary or School-level Youth Assistant who is a lecturer or teacher is allowed to spend 50% of their time according to standard teaching hours doing union and Association work. Those who are not lecturers or teachers but also hold the position of Union Secretary or Youth Assistant at the school level are allowed to spend 50% of their working time doing Union and Association work;

+ Deputy Secretary of the school Youth Union, President of the Student Union, President of the school-level Youth Union who are lecturers and teachers are allowed to spend 40% of their time according to standard teaching hours doing union and Association work. Those who are not lecturers or teachers but also serve as Deputy Secretary of the School Union, President of the Student Union, President of the school-level Youth Union are allowed to spend 40% of their working time doing Union and Association work;

+ Vice President of the Student Association, Vice President of the school-level Youth Union who are lecturers and teachers, are allowed to spend 30% of their time according to standard teaching hours doing union and Association work. Those who are not lecturers or teachers but also hold the position of Vice President of the Student Association or Vice President of the school-level Youth Union are allowed to spend 30% of their working time doing Union and Association work.

- For Union branches under school-level Unions with 1,000 students or more:

The Secretary of the Union branch is a lecturer and teacher who is allowed to spend 40% of the time according to standard teaching hours doing union and Association work. Union branch secretaries who are not lecturers or teachers are allowed to spend 40% of their working time doing Union and Association work.

- For high schools, boarding high schools for ethnic minorities, and continuing education centers:

+ Youth Union Secretary or Youth Assistant, Youth Union Advisor of schools with 28 classes or more are allowed to spend 85% of the time according to standard teaching hours/week to do Union and Association work;

+ Youth Union Secretary or Youth Assistant, Youth Union advisor of schools with less than 28 classes are allowed to spend 70% of the time according to standard teaching hours/week to do Union and Association work;

+ Deputy Secretaries of Youth Unions of Schools with 28 classes or more are allowed to spend 50% of their time according to standard teaching hours/week doing union and Association work;

+ Deputy Secretaries of Youth Unions of schools with fewer than 28 classes are allowed to spend 35% of their time according to standard teaching hours/week doing union and Association work.

The regulations on the number of students in points a, b, c, d, and dd above only apply to full-time students. In the event of exceeding the time limit according to regulations, Union and Association officials who are lecturers and teachers are entitled to overtime benefits; Union and Association officials who are not lecturers or teachers are not entitled to overtime work.

(ii) Regarding allowances for union work:

- For universities:

+ The Union Secretary and the Secretary of the Union Executive Committee are entitled to allowances at the level of University Department Heads;

+ Deputy Secretary of the Youth Union, Deputy Secretary of the Youth Union's Executive Committee, and President of the Student Union are entitled to allowances at the level of Deputy Head of the University Department;

+ The Vice President of the Student Association is entitled to the same allowance as the Deputy Head of Department.

- For member schools and faculties of universities; academies, universities, colleges, vocational colleges, professional secondary schools, vocational secondary schools, and university preparatory schools:

+ Youth Union Secretary and School-level Youth Assistant receive allowances like Department Heads;

+ Deputy Secretary of the Youth Union, President of the Student Union, President of the school-level Youth Union are entitled to the same allowance as Deputy Head of Department;

+ Vice President of the Student Association, Vice President of the school-level Youth Union, Secretary of the Union branch
(for Union branches with 1,000 students, students or more) are entitled to the allowance as Deputy Head of Department under the faculty.

- For high schools, boarding high schools for ethnic minorities, and continuing education centers:

+ Union Secretary, Deputy Secretary, Youth Assistant and President of the Youth Union are entitled to the same allowance as the Professional Team Leader;

+ The Vice President of the Youth Union is entitled to the same allowance as the Professional Deputy Team Leader.

- In case Union or Association officials are lecturers, teachers, or non-lecturers, teachers hold positions with allowances equivalent to or higher than the allowances of Heads, Deputy Heads, Heads of Departments, Deputy Heads of Departments, Deputy Heads of Departments, Heads of Professional Teams, and Deputy Heads of Professional Teams.

Allowances for Union and Association officials are paid during the same monthly salary period.
