Policies and regimes for nurturing and nursing facilities for people with meritorious services, according to Article 134 of Decree 131/2021/ND-CP, are as follows:
- Regarding the number of people working at the facility, the Ministry of Labor, War Invalids, and Social Affairs shall preside over and coordinate with the Ministry of Home Affairs to submit it to the Government for regulation.
- Regarding infrastructure: the state budget ensures the construction, renovation, upgrading, repair, maintenance, and procurement of equipment, vehicles, and tools for nursing facilities for people with meritorious services.
+ Investment projects to build facilities for nurturing and nursing people with meritorious services shall comply with the provisions of the law on public investment.
+ For projects to renovate, upgrade, repair, and maintain nurturing and nursing facilities for meritorious people that require support from regular expenditures from the central budget to implement the Ordinance on Incentives for People with Meritorious Service to the Revolution 2020, documents must be sent to the Ministry of Labor, War Invalids, and Social Affairs before the time of budget allocation.
Documents requesting financial support for renovation, upgrading, repair, and maintenance projects:
++ For projects to renovate, upgrade, repair, and maintain nursing facilities and welcome people with meritorious service, request support from regular expenditures from the central budget to implement the Ordinance on Incentives for people with meritorious services to the revolution 2020 of VND 500 million or more:
++ Decision to approve the project or approve the technical-economic report of the Chairman of the Provincial People's Committee or the Director of the Department of Labor, War Invalids, and Social Affairs for nurturing and nursing facilities for people with meritorious services managed by localities or by the Minister of Labor, War Invalids, and Social Affairs or an agency authorized and approved by the Ministry of Labor, War Invalids, and Social Affairs for nurturing and nursing facilities for people with meritorious services under the Ministry of Labor, War Invalids, and Social Affairs, enclosed with documents as a basis for approval according to current regulations.
For projects with a total investment of less than 500 million VND: Decision approving the repair and maintenance cost estimate of the Head of the management unit of the nurturing and nursing facility for meritorious people. In case the construction is damaged due to natural disasters, storms, floods, fires, or force majeure reasons, there must be a Decision approving the repair of the construction from the competent authority according to the above regulations including a full explanation of the content that needs to be repaired or overcome.
For locally managed nursing and nurturing facilities for people with meritorious services: Department of Labor, War Invalids, and Social Affairs is responsible for preparing and synthesizing cost estimates for renovation, upgrading, repair, and maintenance into the cost estimate for implementing the local Ordinance on Incentives for People with Meritorious Service to the Revolution 2020; synthesizing and sending dossiers and documents issued under appropriate authority to the Ministry of Labor, War Invalids, and Social Affairs.
For nurturing and nursing facilities for people with meritorious services under the Ministry of Labor, War Invalids, and Social Affairs: The Ministry of Labor, War Invalids, and Social Affairs is responsible for approving or decentralizing approval according to the above regulations and synthesizing general estimates to ensure facilities for nurturing and nursing people with meritorious services to the revolution.
+ For funding for purchasing equipment, facilities, tools, and instruments of nursing and nurturing facilities for meritorious people from regular expenditures of the central budget for implementation of the Ordinance on Incentives for People with Meritorious Service to the Revolution 2020 to the Revolution must be proposed in the annual estimate sent to the Ministry of Labor, War Invalids, and Social Affairs.
For locally managed nursing and nurturing facilities for people with meritorious services: the Department of Labor, War Invalids, and Social Affairs is responsible for preparing and synthesizing procurement cost estimates into a cost estimate for implementing the local Ordinance on Incentives for People with Meritorious Service to the Revolution 2020 sent to the Ministry of Labor, War Invalids and Social Affairs.
For nurturing and nursing facilities for people with meritorious services under the Ministry of Labor, War Invalids, and Social Affairs: The Ministry of Labor, War Invalids, and Social Affairs has overall responsibility in the annual budget to ensure facilities for nurturing and nursing people with meritorious services to the revolution.
The functions, tasks, and organizational structure of nursing and nurturing facilities for people with meritorious services according to Article 133 of Decree 131/2021/ND-CP are as follows:
- Facilities nurturing people with meritorious service have the function and task of nurturing wounded and sick soldiers with a physical injury rate of 81% or more.
- Nursing facilities for people with meritorious services have the functions and tasks of nursing and restoring health to people with meritorious services and their relatives.
- The Ministry of Labor, War Invalids, and Social Affairs specifies the functions, tasks, and organizational structure of nursing and nurturing establishments for meritorious people under its management authority.
The Provincial People's Committee shall specify the functions, tasks, and organizational structure of nursing and nurturing establishments for meritorious people under its management authority.
